PERRY NUCLEAR POWER PLANT, UNIT NO. 1 - EXEMPTION FROM THE REQUIREMENTS OF 10 CFR 54.17(A) (EPID L-2020-LLE-0089)
Dear Mr. Payne:
The U.S. Nuclear Regulatory Commission has approved the enclosed exemption from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR), Section 54.17(a), for the Perry Nuclear Power Plant, Unit No. 1 (PNPP). This action responds to the Energy Harbor Nuclear Corp. (EHNC) letter, dated May 15, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20136A353), requesting an exemption from 10 CFR 54.17(a)s requirement that an application for a renewed license be in accordance with Subpart A of 10 CFR Part 2, and, more specifically, 10 CFR 2.109(b). Section 2.109(b) provides timely renewal protection to licensees that submit sufficient license renewal applications at least 5 years before the expiration of the existing license. Thus, this exemption allows EHNC to submit a license renewal application for PNPP at least 3 years prior to the expiration of its existing license and, if the application is sufficient, to still receive timely renewal protection.
