SURRY POWER STATION, UNIT NOS. 1 AND 2 - DELAY IN SUBSEQUENT LICENSE RENEWAL APPLICATION DECISION

Dear Mr. Stoddard:

The purpose of this letter is to inform you that the U.S. Nuclear Regulatory Commission (NRC or staff) has completed its review of currently-submitted information associated with your application for subsequent renewed licenses for Surry Power Station, Unit Nos. 1 and 2 (Surry).

The original target date for a decision on the application was June of 2020 (an 18-month review time). As described below, you plan to provide updated information concerning the status of the Coastal Zone Management Act (CZMA) within 30 days of May 20, 2020. The NRC anticipates that it will be able to complete its review of the application within four weeks of receipt of the updated information, but the actual time needed to review the information will be fact-dependent. As a result of this delay, the 18-month decision schedule will not be met.

By letter dated October 15, 2018 (ADAMS Accession No. ML18291A842), as supplemented by letters dated through May 20, 2020 (ADAMS Accession No. ML20142A290), Virginia Electric and Power Company (Dominion) submitted to the NRC an application to renew the Renewed Facility Operating License Nos. DPR-32 and DPR-37 for the Surry Unit Nos. 1 and 2, respectively. Dominion submitted the application pursuant to Title 10 of the Code of Federal Regulations Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants, for subsequent license renewal.

In a letter dated December 3, 2018 (ADAMS Accession No. ML18320A236) and Federal Register Notice (FRN) dated December 10, 2018 (83 FR 63541), the NRC staff concluded that the application was acceptable for docketing and provided the 18-month subsequent license renewal review schedule, which targeted the issuance of the subsequent renewed licenses for June of 2020.

In a letter dated February 5, 2020 (ADAMS Accession No. ML20029D838), the NRC staff issued a request for additional information (RAI) related to the Conditional Concurrence finding on Dominions application for the CZMA consistency certification that was issued by the Virginia Department of Environmental Quality (VDEQ). The conditions relate to concerns raised by the Virginia Department of Game and Inland Fisheries (VDGIF) regarding measures to minimize impacts to fishery resources from operation of Surrys cooling water intake.

D. Stoddard In the RAI, the NRC staff requested a revised CZMA consistency certification determination for Surrys subsequent license renewal or other updated correspondence issued by the Commonwealth of Virginia that updates the status of the CZMA consistency certification process. This documentation should show that either the conditions stated above have been resolved or that Dominion and the Commonwealth of Virginia have reached other terms that resolve Commonwealths Conditional Concurrence finding. Alternatively, the NRC staff stated that Dominion may provide information related to any notice of appeal that has been filed with the Secretary of Commerce by Dominion in accordance with 15 CFR 930.125.

In a letter dated February 28, 2020 (ADAMS Accession No. ML20062C033), Dominion responded to the RAI that Dominion has been working with the VDEQ and VDGIF with the goal of obtaining a revised CZMA consistency determination letter from the VDEQ. Dominion stated that discussions were still in progress and that it could not anticipate when a revised CZMA consistency determination letter would be obtained, and an update would be provided no later than May 22, 2020. In a letter dated May 20, 2020 (ADAMS Accession No. ML20142A290),

Dominion provided an update, stating that it continues to correspond with VDEQ and VDGIF with the goal of obtaining a revised CZMA consistency determination letter from the VDEQ.

Dominion informed the NRC that discussions are still in progress and Dominion cannot anticipate when a revised CZMA consistency determination letter will be obtained. Dominion committed to provide an update on the status of the ongoing discussions or a response to the RAI within 30 days of the May 20, 2020 letter. Upon receipt of the CZMA consistency determination letter, the NRC will be able to provide a revised estimated decision date.
