Dear Mr. Davis:

Reference (a) provided the results of an inspection at Byron Station by Mr. Pirtle of your staff between January 28 and February 18, 1988. During this inspection, certain activities appeared to be in violation of NRC requirements. Attachment A of this letter contains commonwealth Edison's response to the violation enclosed with reference (a). On April 7, 1988, Commonwealth Edison was granted a one-week extension on the due date for the response to the Notice of Violation by Mr. J.R.

Creed of your staff.

We have concluded that the issue discussed in this violation should not be considered a failure to implement the Byron, Security plan.

In our view, the issue involves a question about the original design of the E-field system detection capability.

Therefore, we are requesting the NRC to reclassify this violation to an open item. We have proposed a change to the security plan to help resolve the issuc.

In addition, we would like to arrange a meeting with the Region III safeguards staff to discuss B-fiald system detection capability further.

Attachment B of this letter contains an executive briefing of an investigation of firewatch activities at Byron Station. This briefing material was requested by the NRC staff during a meeting on March 8, 1988.

Commonwealth Edis>n's investigation has confirmed that these firewatch tour deficiencies did not extend to the security guard force or any of its respective duties.
