. l NOTICE OF VIOLATION l Tennessee Valley Authority Docket Nos. 50-327,328 License Nos. DPR-77,79 Sequoyah Nuclear Power Plant Units 1 and 2 EA 88-During an NRC inspection conducted on January 25-29, 1988, a violation of NRC requirements was identified. In accordance with the "General Statement of ]

Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violation is listed below:

A. 10 CFR Part 50, Appendix B, Criterion XVI, states, in part, "Measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected. In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition.

Paragraph 11 of Attachment 4 to Temporary Instruction, TI-105, "Dedicating Comercial Grade Items for Use as Basic Components," Revision 1, dated August 18, 1987, which was developed in response to NRC Inspection Report 50-327, 328/86-61, states, in part, "A check that the part number is the same does not indicate that an item is a direct replacement. Critical characteristics must be checked."

C Contrary to the above, as of the date of the inspection, TVA failed to take adequate corrective action to correct deficiencies in the areas of procurement of safety-related equipment which were identified in TVA's Nuclear Safety Review Staff Report R-84-17-NPS and NRC Inspection Reports 50-327,328/86-61 and 50-327,328/87-40. Examples of TVA's failure to take adequate corrective actions are: (1) dedication package 5137 dedicated a comercial grade tempecature switch used in a safety-related plant appli- l cation based solely on part number; (2) dedication package 5252 dedicated a comercial grade valve positioner used in a safety-related application  !

l based on model number and part number from a vendor who had no applicable QA program and was not on the TVA approved supplier list (ASL); and )

(3) dedication package 5243 dedicated a comercial grade safety relief valve with adequate critical characteristics for dedication; however, receipt inspection was based on part number verification and an unsupported Certificate of Compliance (the supplier's comercial grade {

QA program had not been reviewed and approved by TVA). Therefore, the dedication was, in essence, based solely on part number verification. l This is a Severity level IV violation (Supplement I).

2-Pursuant to the provisions of 10 CFR 2.201, Tennessee Valley Authority is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Director, Office of Special Projects and a copy to the NRC Resident Inspector at the Sequoyah Nuclear Plant, within thirty days of the date of the letter transmitting this Notice. This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the licensee should not be modified, suspended, or revoked or why such other action as may be proper should not be taken. Consideration may be given to extending the response time for good cause shown.
