PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about June 13, 1988 to Virginia Electric and Power Company.
This action is based on a Severity Level III violation for failure t verify operability of required boric acid piping heat tracing circuits on a monthly basis as required by the Plant Technical Specifications and the fact that this problem existed since December 1984 for Unit I and since May 1985 for Unit 2 without being corrected. The escalation and mitigation factors of the Enforce-ment Policy were considered and no adjustment was deemed appropriate.
The licensee's extensive corrective actions and past performance were offset by the length of time that the problem existed and the opportunities that the licensee had to identify and correct the problem.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
