Requestfor Consent to the Indirect Transfer of Control Pursuant to 10CFR50.80 Gentlemen:
By letter dated July 21,1998, Niagara Mohawk Power Corporation (NMPC) submitted, pursuant to 10 CFR 50.80, a request for consent to the indirect transfer of control over NMPC's interest in Operating License Nos. DPR-63 and NPF-69 for, respectively, Unit I and Unit 2 of the Nine Mile Point Nuclear Power Station in connection with the creation of a new holding company. Based on further discussions with the Staff, NMPC hereby supplements its Application to clarify a commitment regarding divestiture contained on page 10 of the Application.
Specifically, NMPC commits as follows:
NMPC will provide the Director of the Office of Nuclear Reactor Regulation a copy of any application, at the time it is filed, to transfer (excluding grants of security interests or liens) from NMPC to its proposed parent, or to any other affiliated company, facilities for the production, transmission, or distribution of electric energy having a depreciated book value exceeding ten percent (10%) of NMPC's consolidated net utility plant as recorded on NMPC's book of accounts.
