Modify the response to the letter, first paragraph, page 2, to as follows: Delete the first sentence. Change the second sentence to read, "The Office of Analysis and Evaluation of Operational Data (AEOD) indicates that the current version of NMED is adequate for the initial ,

phase of the orphan source project."

- Additionally since OSP has no specific guidance on whether or not the Chairman would mandate funding this requirement, OSP should provide a cover memo to the Chairman with the i proposed response to CRCPD which outlines the information regarding the AEOD current l estimates as to cost and that the requirement is unfunded. If the Chairman does not support j funding this initiative then the letter to the CRCPD would need to be redrafted accordingly. The following text outlines the funding issue for the memo to the Chairman:

AEOD's budget for NMED is $296K in FY 1999 and $300K in FY 2000 - FY 2001. AEOD's l estimates of the additional one-time costs for the revisions and enhancements to NMED to include non AEA orphan sources in the database is $200K over a 3 - 5 year period beginning in FY 1999. In addition, costs willincrease by $100K per year once all of the States begin reporting the additionalinformation in NMED. The on-going requirement for an additional

$100K per year is based on the database workload for data review and data entry doubling, with the current effort at $100K per year. AEOD indicates the funds for the non AEA orphan source program are not currently included within their budgeted resources and that there is no capability to fund this requirement out of the AEOD budget. 1 g b '

1. The staff plans to review and assess the feasibility of budgetary eprogramming to secure funding for this effort. If budget reprogramming is not f sible, FY 2000 is the first opportunity to include the funds in NRC's budget.
2. The staff plans to evaluate the feasibility of NRC funding for he software revisions to the NMED program and the feasibility of receiving joint support rom the other Federal stakeholders involved, i.e., DOE, FEMA and EPA, for the dditional long-term maintenance costs of this effort.

Dear Chainnan Jackson:

As discussed in my testimany before the U.S. Nuclear Regulatory Commission (NRC) on January 21,1998, concerning imnroving control over generally and specifically licensed devices, the Conference of Radiation Control Program Directors, Inc. (CRCPD) has established the Committee on Unwanted Radioactive Ma'.crials. The goal of this committee is to develop a dynamic natiomvide system that will effectively manage orphan or other umvanted sources. This committee, chaired by Joe Klinger, is comprised of members from the states. The committee met with NRC, the Environmental Protection Agency (EPA), and the Depanment of Energy (DOE) on January 26-27, 1998, to develop a strategy to accomplish the committee's goals.

The Committee on Unwanted Radioactive Materials was acutely aware of the need for immediate action and agreed to survey the states and the NRC to obtain an accurate inventory of orphan or unwanted sources currently existing throughout the country. They also examined existing databases, Internet Web pages, and other such electronic tools to try to find ones that could be adapted for the needs of the orphan source program without the need for major new initiatives. In consultation with the NRC staff, the committee would like to propese the use of the NRC Nuclear Materials Events Database (NMED) for the reporting needs of our program. The CRCPD will modify its Web page to facilitate proper orphan or other unwanted sources dispositioning.

The use ofNMED presents a number of advantages. The NMED system would only require

-P a minor modification to add a table to accommodate the information necessary to track orphan sources on a nationallevel. The NRC would be providing an attractive incentive to all states to use the NMED system. The states would have an enhanced ability to locate and track orphan sources on a national level. It has been the belief of many of the states that become actively involved in the orphan source issue that some percentage of these incidents go unreported, but the magnitude of the

. problem has not been quantified. If accurate tracking information were available, it would provide the quantitative justification needed for agencies such as the NRC, DOE, and the EPA to pursue federal funding to properly disposition orphan sources throughout the countnj.

The EPA has provided the initial $200,000 to get this committee started, and if the committee is successfulin leveraging other resources for its needs,(i.e., the use of the NMED system with slight modification, and the CRCPD web page,) they will be able to allocate most of the funding to A Partnership Dedicated to Radiation Protection

NRC would provide "in-kind" support for the work of the committee, and push the committee's schedule ahead by an estimated six months. It appears that adding one more table to the existing f

. NMED system, providing the software to access and use NMED and necessaiy training to states that L

have not already received this support, and providing funds for maintenance and data input are all that will be necessary. IfNRC has a less expensive and more efficient proposal, the committee would be j pleased to explore it for the mutual benefit of all stakcholders.

j. Please note that one important element of the CRCPD Orphan Source Initiative is to address  !

l the problem comprehensively, and that includes radioactive material that is not Atomic Energy Act l l regulated material. Discrete, technologically enhanced, naturally occurring and accelerator-produced l radioactive ~ material are also in need of homes, and are included in the scope of the coianittee's goals.
