.U' The Chairman of the House Committee on Interstate and Foreign Com-merce has requested the Commission's views on H.R. 6116, a bill which would extend NRC licensing authority over certain commercial and Department of Energy waste disposal facilities, and establish criteria for characterizing research and development waste activi-ties. N IN TIIE IIOUSE OF REPRESENTATIVES O DECEMBER 12,1979 Mr. UDALL introduced the following bill; which was referred jointly to tho Committees on Interior and Insular Affairs and Interstate and Foreign Commerce A BILL To amend section 202 of the Energy Reorganization Act of 1974 to provide for the licensing of facilities for the disposal O of spent nuclear fuel, transuranie wastes, and high-level radionetive wastes.
1 Be it enacted by the Senate and House of Representa-2 tives of the United States of America in Congress assembled, 3 That section 202 of the Energy Reorganization Act of 1974 4 is amended-5 (1) by amending paragraphs (3) and (4) to read as 6 follows:-

1 "(3) Facilities used primarily for the receipt and '
2 storage of the following wastes resulting from activities 3 licensed under such Act: _ high-level radioactive waste, 4 transuranic waste, and spent nuclear fuel.
5 "(4) Retrievable surface storage facilities and 6 other facilities authorized for the purpose of subsequent 7 long-term storage of-8 "(A) high-level radioactive waste, /
9 "(B) transuranic waste, or O 10 "(0) spent nuclear fuel, 11 generated by the Administration, which are not used 12 for, or are part of, research and development activi-13 ties."; and 14 (2) by adding at the end thereof the following new 15 sentence:
10 "For purposes of this section, facilities designed, constructed, 17 'or operated for the purpose of long-term deep geologic stor-9 18 age of high-level radioactive waste, transuranic waste, or 10 spent nuclear fuel in quantities which contain at least one 20 kilogram of transuranic waste or the curie equivalent of ten 21" metric tons of spent fuel shall not be considered research and 22 development activities.". ,
