RADIDACTIVE WASTE. AUTHORITY This is in response to your request concerning Section 21(d) of MichigJn Act 204 which addresses the feasibility of disposing of lu-level radioactive wastes at existing nuclear power reactor sites. Mr. David Hales of the Michigan Low-Level Radioactive Waste Authority had requested conynents frorn the NRC on this concept.

When this type of isw has been posed to NRC in the past, the NRC has taken the position that the policy for the disposal of low-level radioactive waste has been cstablished by the Low-Level Radioactive Waste Policy Amendments Act of1985(Act). Any disposal cf low-level radioactive wastes would have to comply with the Act. Furthermore, any disposal of low-level radioactive waste would have to comply with the requirements of 10 CFR part 61. The NRC has issued guidance docuinents for assisting persons applying for an NRC license pursuant to 10 CFR Part 61. The principal documents that provide this guidance are (1) NUREG-1274, "Review Process for Low-level Radioactive Waste Disposal License Application Under Low Level Radioactive Waste Policy Amendments Act";

(2) NURfG-1399, Rev.1, "Standard format and Content of a License Application for a Low-Level Radioactive Waste Disposal Facility"; (3) Regulatory Guide 4.18, "Str.ndard Fornat and Content of Environmental Reports for Hear-Surface Disposal of Radioactive Waste"; (4) NUREG 1200, Rev.1, "Standard Review Plan for the Review of a License Application for a low-Level Radioactive Waste Disposal Facility"; and (S) NUREG-1300, "Environment 61 Standard Review Plan for the Review of a License Application for a Low-Level Radioactive Waste Disposal Facility." The guidance set forth in these docurrents should be considered if this dispcsal concept is pursued. These documents are available from the National Technical Information Service, l
