Dear Mr. Cruse:
This is to acknowledge receipt of your letter dated May 21,1998,in response to our letter dated May 7,1998, dealing with an Emergency Notification Report of May 1,1998, on a positive alcohol test result for a licensed operator. Your response is acceptable and we have no further questions on this matter.
Also we reviewed your letter which requested that the attachment 2 be withheld from public disclosure in accordance with 10 CFR 2.790. Attachment 2 indicates the individual's name, license number, and job responsibility other than being assigned to Control Room duties. The letter to him and the May 21,1998, letter from BGE will be placed in his 10 CFR Part 55 docket file. Neither letter will be placed in the NRC Public Document Room.
We have reviewed BGE's request based on the requirement and criteria of 10 CFR 2.790, and have determined that the submitted information sought to be withheld contains privacy information. Therefore, the privacy information so identified by BGE will be withheld from public disclosure pursuant to 10 CFR 2,790(a)(6) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding information from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents, if the need arises, we may send copies of the information to our consultants working in this area. We will, of course, l
ensure that the consultants have signed the appropriate agreements for handling proprietary information.

should promptly notify the NRC. You should also understand that the NRC may have
