SUPPORTING STATEMENT FOR A SURVEY OF LICENSEES FJSSESSING STRATEGIC SPECIAL NUCLEAR MATERIAL Justification Need for and Practical Utility of Information Collected As part of its function to protect the public health and safety and the common defense and security, the Nuclear Regulatory Commission (NRC) regulates certain nuclear facilities where strategic special nuclear material (SSNM) is used and/or stored. During a recent re-evaluation of the security posture at certain licensed facilities, it was recognized that many nonpower reactor (NPR) facilities (includes research, test and critical facilities) had on-hand SSNM in the form of unirradiated high enriched uranium (HEU) fuel that was not needed for their current operations. Thus, the NRC believed that prudenco dictated the taking of reasonable steps to decrease the potential for any adverse consequences from the possession of HEU in excess of quantities sufficient for the maintenance of normal operations or for the replacement of depleted fuel and failed fuel elements. Accordingly, the NRC on September 27, 1985 issued to 31 NPR licensees an Order to Show Cause why all excess HEU fuel should not be removed to a secure location away from their reactor site. Many responses'to the Order indicated that licensees were going to ship excess fuel in order to comply with the Order. However, exact details of the amount to be shipped and the remaining amount that would be left on-site were not always given. In addition, many licensees did not respond in writing to the Order.
Therefore, it is not clear whether these licensees have or plan to ship any HEU off site.
In addition to the above, the NRC is considering whether to propose additional domestic physical protection measures to increase the level of conservatism in the protection of the more strategically significant classes of Category !!
material (i.e., SSNM of moderate strategic significance).

! .i l In order to determine the residual potential risk associated with the possession of SSNM at these licensed facilities, the NRC needs to know the j amount and the characteristics of the SSNM remaining at these facilities.
Licensee responses to the information requested will be used by the NRC in its l deliberations regarding the need for additional physical protection measures.

The Office of Nuclear Material Safety and Safeguards has identified information which is needed to aid the NRC in its deliberations regarding the j need for additional physical protection measures. The specific information

Most of the licensees already have certain of the information readily at hand as a result of the Order to Show Cause. Thus, 30 days is a reasonable time for submitting their information.

1 Entimated Cost to the Federal Government It is estimated that the evaluation of information collected will require an I average of eight hours of NRC ntaff time per report. For 33 renpondents the evaluation will require 264 hourn (8 ntaff houre/ report x 33 reportn = 264

hours). Labor cost at $60 per staff hour will be $ 15,840 (8 staff hours /
report x 33 reports x $60 per staf f hour = $15,840). No additional costs are anticipated. Therefore, the total cost to the Federal Government will be approximately $15,840.

ENCLOSURE A Thirty (30) nonpower reactor licensees will be requested to provide specific information on the following:
- a. The number of elements, plates, or other SSNM, includis q grams U-235, the associated enrichment and the specific form (e.g., IRIGA fuel, UA1 fuel, etc.), of untrradiated high enriched uranium (HEU) which was or is being shipped in order to comply with the September 27, 1985 Order to Show Cause,
- b. The number of full and/or partial HEU fuel elements / plates burned-up in a normal 90 day period, including grams U-235, the associated enrichment and the specific form (e.g., TRIGA fuel, UA1 fuel, etc.),
- c. The maximum amount of unirradiated fuel elements / plates, including grams U-235, the associated enrichment and the specific form (e.g., TRIGA fuel, UA1 fuel, etc.), which will be kept to maintain a 90 day period of normal operation,
- d. The type of element (s)/ plate (s), including grams U-235, the associated enrichment and the specific form (e.g., TRIGA fuel, UA1 fuel, etc.), that will be kept on site to replace one failed element for each different type element in the core,
- e. The amount of strategic special nuclear material (SSNM) kept on-site in forms other than f uel, including grams U-233, U-235 and Pu, the associated enrichment and the specific form (e.g., fission chambers, plutonium-boryllium sources, etc.),
- f. The number of irradiated fuel elements, plates, or other SSNM currently:

- a. The typical and current amount of unirradiated strategic special nuclear material (SSNN) kept on-site, including grams U-233, U-235, and Pu, the associated enrichment and the specific form (e.g. , fission chambers, plutonium-beryllium sources, etc.),
- b. The typical and current amounts of irradiated SSNM on-site, including grams U-233. U-235, and Pu, the associated enrichment and the specific form (e.g. , fission chambers, plutonium-beryllium sources, Pu in spent fuel etc.), and to the extent practical without violating ALARA principles, the identification of the rem per hour (rem /hr) at 3 feet for each item (i.e. , <.1 rem /hr >.1 -<10 rem /hr, >10 - <100 rem /hr, >100 - <300 rem /hr,
>300 - <500 rem /hr, >500 - <1000 rem /hr, and over 1000 rem /hr,
- c. The amount and dates of unirradiated SSNM shipments received at the facility within the last five (5) years, including grams U-233, U-235 and Pu, the associated enrichment and the specific f orm (e.g. , fission chambers, plutonium-beryllium sources, etc. ),
- d. The amount and dates of irradiated SSNM shipments received at the facility within the last five (5) years, including grams U-233 U-235 and Pu, the associated enrichment and the specific form (e.g., spent fuel), and
- e. Any plans for the shipment of irradiated and/or unirradiated SSNN, including approximate amounts and dates of shipment.
