Dear Mr. Collopy:

This is in response to your April 25, 1988 request for an exemption from the requirement of 10 CFR 70.58(g)(3) to take appropriate investigative and correc-tive action to reconcile shipper / receiver differences that are statistically significant at the 95 percent confidence level axcept those shipments which involve differences of 50 grams or less of U-235. In place of this requirement you propose early implementation of 10 CFR 74.59(h)(1)(iii) which requires investigative and corrective action to reconcile shipper / receiver differences involving finished fuel shipments that are statistically significant at the 95 percent confidence level and the shipper / receiver difference exceeds the larger of 0.5 percent of the amount of Strategic Special Nuclear Material (SSNM) in the container, lot, batch, or shipment, as appropriate, or 50 grams of SSNM.

We have reviewed your request and have determined that granting it will not adversely affect the comon defense and security nor the public health and safety and is otherwise in the public interest. Accordingly, we are adding a new License Condition 8.1 to Amendment SG-1 to your License No. SNM-368, effective immediately, to read as follows:

8.1 Notwithstanding the requirement of 10 CFR 70.58(g)(3) to take appro-priate investigative and corrective action to reconcile shipper / receiver differences that are statistically significant at the 95 percent confidence level except those shipments which involve differences of 50 grams or less of U-235, the licensee may take investigative and corrective action when shipper / receiver differences exceed twice the estimated standard deviation of the difference estimator and the larger of 0.5 percent of the amount of SSNM in the container, lot, batch, or shipment, as appropriate, or 50 grams of SSNM.

We have determined that your letter dated April 25, 1988 contains information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section e009210209 000516 ADOCK 0700 1 OP'3 PDR
