Box 128 San Clemente, California 92674-0128 SUBJECT: NRC INSPECTION REPORT 50-361/98-12; 50-362/98-12 AND NOTICE OF VIOLATION Dear Mr. Ray: From July 13-17,1998, a physical security program inspection was conducted at your San Onofre Nuclear Generating Station, Units 2 and 3 reactor facilities. An initial exit was i conducted on July 17,1998. Subsequent telephonic exit briefings were conducted on August 21 and October 7,1998. The enclosed report presents the scope and results of that ' inspection. During this inspection, five violations of NRC requirements were identified. The findings from j this inspection, as well as several past NRC inspections, have revealed multiple problems in a number of different areas within the security program. Actions taken and planned by your staff to address security program implementation problems were discussed during a management meeting in the Region IV office on July 7,1998. We will continue to review the effectiveness of those actions, as well as, the corrective actions in response to the finding from this inspection, during future NRC inspections. The violations noted in the enclosed report included a 10 CFR 50.9 violation for submitting inaccurate information to the NRC, inadequate compensatory measures, inattentive security officers manning required positions, inadequate personnel access control, and inadequate access authorization. The violations involving inadequate compensatory measures and submitting inaccurau information to the NRC are cited in the enclosed Notice of Violation (Notice), The violations involving the inattentive security officers, inadequate personnel access control, and inadequate access authorization were identified and corrected by your staff and qualified for treatment as noncited violations. Therefore, they are not included in the enclosed Notice. The violation involving inadequate access authorization while qualifying for treatment as a ' noncited violation is of additional concern because a previous similar violation occurred in 1995 ' l , 9810140137 981007 PDR ADOCK 05000361 0 PDR

Although the recent violation was not considered a repetitive violation in accordance with the NRC Enforcement Policy, NRC is concerned with individuals being granted access who have not passed a preemployment fitness-for-duty screening. Your continued attention to and oversight of this area is encouraged. Please note that you are required to respond to Violation B in the Notice and should follow the instructions specified when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements. For Violation A in the Notice, the NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence are already adequately addressed on the docket in the enclosed inspection report. Therefore, you are not required to respond to Violation A unless the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in the enclosed Notice. In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its enclosures, and your response will be placed in the NRC Public Document Room (PDR).
