APPENDIX A }(nf j Automatic Switch Company EA 88-233 Docket No. 99900369/88-01 NOTICE OF VIOLATION During an inspection conducted on June 27, 1988 through July 1,1988 violations of NRC requirements were identified. In accordance with the "General Statement of Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988)theviolationsarelistedbelow:

Section 21.21, "Notification of Failure to Comply or Existence of a Defect," of 10 CFR Part 21 requires, in part, that each individual or other entity subject to the regulations adopt appropriate procedures to provide for evaluating deviations or informing the licensee or purchaser of the deviation in order that the licen-see or purchaser may cause the deviation to be evaluated unless the deviation has been corrected, and assure that a director or responsibic officer subject to the regulations of this part or a designated person notifies the Commission when he obtains information reasonably indicating a failure to comply with any regulation or defect affecting a basic component.

A. to the above, numerous examples were revealed where Automatic Switch Contrary Company (ASCO) has knowledge of deviations, omissions, and/or potential generic problems and failed to either evaluate them for potential reporta-bility or inform the licensee so they could evaluate them for reportability.

Examples are as follows (88-01-01):

(1) Engineering Investigation Report (E1) 3584, dated October 8, 1981 -

Inadequate end margin on a nuclear line, Class H, electrical coil and use of silicone rubber by the coil manufacturer to mask the problem

[ appears generic to 220-339 nuclear line that these coils which were originally procured comercial grade may have this problem];

(2) El 3850, dated October 8, 1985 - Valves not shifting adequately in the ASCOnuclear(NP)8316 series [HopeCreek];

(3) El 3871, dated February 26, 1986 - Insufficient differential pressures across certain NP 8316 solenoid valves - valves stuck open [ Comanche Peak];

(4) E! 3916, dated July 24, 1986 - Pilot orifice drilled in wrong location on NP 8321 solenoid series. Results in hecitation - found in 17 NP 8321 valves; (5) El 3643, dated May 18, 1982 - A 5/64-inch hole was being drilled in wrong location - Involves the 8321 solenoid body that is used on the nuclear NP series; (6) El 3825, dated March 19, 1985 - Diaphragms interchanged between ports causing sluggish shifting in NP 8316 line; G809210150 880921 PDR OA999 EMVAUSQj 99900369 PDL

2 (7) El 3873, dated July 30, 1986 - Orifice too small causing lower disc to not operate properly - found on nuclear 206-381 solenoid valve line; (8) El 3847, dated July 24, 1985 - Ethylene Proylene diaphragm "wicking" problems; (9) El 3902, dated October 30, 1986 - Several solenoid valos were found to be shifting slowly or not at all; (10) El 3604, dated March 11, 1982 - Valves sticking - Ft. Calhoun - Varnish like residue similar to Dow-Corning #805 (NP 8314C29E);

(11) El 3906, dated April 24, 1987 - Valve leaks at 250 psi - involves several Colt /Fairbanks customers (8316 Series); and (12) El 3880, dated December 29, 1986 - Air leakage occurred at 250 psi af ter about one hour of energization (8320A105).

B. Contrary to the above, ASCO has failed to establish an adequate procedure to implement the provisions of 10 CFR Part 21 in regard to its control of potentially reportable items, evaluations and a system to ensure end users or licensees receive hardware-related deviations or failures to comply for their processing (88-01-02).

This is a Severity Level III problem (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, the Automatic Switch Company is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Connission, ATTN: Document Control Desk, Washington, D.C. 20555 within 30 days of the date of this letter transmitting this Notice. The reply should be clearly marked as a "Reply to a Notice of Violation" and should include: (1) the reason for the violation, if h admitted,(2)thecorrectivestepsthathavebaentakenandresults achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
