Dear Mr. McConnell:

This refers to the inspection conducted by Mr. J. J. Petrosino of this office on June 27 through July 1,1988, of your facility at Florhan Park, New Jersey and the discussions of the findings with Messers. H. West, J. Weaver, and other members of your staff at the conclusion of the inspection.

The inspection was conducted as a result of equipment oreration problems that have been identified in several nuclear plants which use Automatic Switch Company (ASCO) three- and four-way electrical solenoid pilot valves. Areas examined during the NRC inspection and our findings are discussed ir. the enclosed report. This inspection consisted of an examination of procedures and representative records, interviews with personnel, and observations by the inspector.

During this inspection it was found that the implementation of your QA program failed to neet certain NRC requirenents. The most significant problem was your

'. failure to evaluate nonconformances and problems for potential reportability or notification of end users in accordance with 10 CFR Part 21. The specific find-ings and references to the pertinent requirerrents are identified in the enclosures to this letter.

In accordance with the "General Statenent of Policy and Procedure for NRC Enforcement Actior.s," 10 CFR Part 2 Appendix C (1988), the violations described in the enclosed Notice has been classified at a' Severity Level III problem because Part 21 reports would have been required if ASCO had adequately performed the required evaluations or had notified the NRC licensees of the deviations. These violations are of significant regulatory concern. However, a civil penalty is not being proposed because pursuant to 10 CFR 21.61, the failure to perform the evaluations did not appear to be the result of a knowing and conscious failure to provide the required notice. Also enclosed is a Notice of Honconformance which describes apparent weakness in your program for corrpliance with 10 CFR Part 50, Appendix B.

The responses reouested by the accompanying notices are not sub,iect to the clearance procedures of the Office of Management and Budget as required by the Papenvork Reduction Act of 1980, PL 95-511. In accordance with 10 CFR 2.790 of the Connission's regulations, a copy of this letter and the enclosed inspection report will be placed in the NRC's Public Document Room.
