Dear Mr. Hill:

We have reviewed the final Georgia regulations, Rules and Regulations for Radioactive Materials, Chapter 391-3-17 which became effective on May 6,1997. The regulations were reviewed by comparison to the equivalent NRC regulations in 10 CFR Parts 19,20,30,34,35, 36, and 71. This review covered all of your regulation revisions made since the February 16, 1996 Integrated Materials Performance Evaluation Program review, and includes all NRC regulation changes needed by October 20,1998, as published in the Federal Reaister (FR) notices, including Medical Administration of Radiation and Radioactive Materials (60 FR 48623).

We also discussed our review of the regulations with you on August 20,1998.

As a result of our review we have identified two comments, as enclosed. These comments must be addressed in order to assure the compatibility of ycor regulations. We note that Management Directive 5.9, Handbook, Part V, paragraph (1)(c)(iii), provides that the enclosed regulations should be adopted by the State as expeditiously as possible, but not later than 3 years after the effective date of the new Commission Policy Statement on Adequacy and Compatibility, i.e., September 3,2000.
