The updating incorporates revisions previously provided to you for review and comment by All Agreement States letter, SP-98-071, " Revision of OSP Internal Procedure B.7 Rule Tables,"

dated August 18,1998.

Please note that for the Part 71, Packaging and Transportation of Radioactive Material, B.7 rule table,'special considerations have been made. The compatibility category designations in the Part 71 rule table were either changed per the proposed revision or they remained the sama depending on which designation provided the Agreement States with the greatest flexibility.

The reason for this consideration is that comments were received that indicate that there is a broader policy issue associated with the adoption of Part 71 requirements by Agreement States. The issue concerns the dual regulatory aspect of transportation regulations. Even if an Agreement State adopted portions of Part 71 as set out in the tables, US Department of Transportation (DOT) regulations would also apply and have preeminence over any State regulations. Consequently, the fundamental question is raised as to whether Part 71 should be c

required for compatibility by NRC at all. Put another way, should an Agreement State be forced to incur the expense of promulgating mirroring regulations for activities when DOT has parallel, superseding regulations? Therefore, NPC will be exploring this matter further.
