HEADQUARTERS Low-level Radioactive Waste Forurn Donald Nussbaumer and Stephen Salomon, State, local and Indian Tribe Programs, (SLITP), and Marie Miller, Region I State Liaison Officer, attended the quarterly meeting on the low-Level Radioactive Waste Forum in Seabrook Island, South Carolina on April 18-19, 1988. The sited States (South Carolina, Washington, and Nevada) reported that Maine is now in compliance with the '

Congressional milestone of January 1,1988. Consequently, only New Hampshire, North Dakota, Puerto Rico, and Vermont remain in noncompliance. One of the main subjects of discussion was a presentation of the NRC Agreement State Program by Donald Nussbaumer. NRC staff from the Office of Nuclear Material Safety and Safeguards (NMSS) and SLITP participated in sessions devoted to Federal technical assistance, NRC guidance on both alternative disposal technologies, and financial assurances. Other topics of interest included State and regional progress reports, State and compact responsibilities, and site selection.

On April 20 there was a site visit to the Chem-Nuclear Systems, Inc. facility located in Barnwell, South Carolina. Low-level radioactive waste burial and transportation operations were observed by Forum participants. In addition, some low-level and high-level radioactive waste solidification facilities which are under construction at the nearby Savannah River Plant were observed.

REGION I MARYLAND Meetina with Department of the Environment for State of Marvland On April 11, 1988, William Russell, Recional Administrator; John McGrath, RegionalStateAgreementsOfficer(SAO);andMarieMiller,RegionalState liaison Officer (RSLO), met with Martin Walsh, Secretary of the newly created Department of the Environment, and his senior staff in Baltimore, Maryland.

The meeting was part of the Region's effort to periodically meet with States ,

to exchange information and discuss areas of interest. Areas of discussion  :

included the following: introduction to Maryland Department of the Environment '

organization, responsibilities and inteffaces with Maryland's Department of Natural Resources, review of the NRC organization and NRC Region I primary responsibilities; the Agreement State program regarding technical assistance from NRC and Maryland's proposed plans to fund the licensing program by assessing fees; and emergency planning. Concerning emergency planning, Secretary Walsh outlined the response role of his Department and plans to work with Pennsylvania and Philadelphia Electric Company to improve emergency preparedness. William Russell stated that NRC Region I plans to participate ,

in the full scale exercise of the Peach Bottom Emergency Plan, which is l scheduled for the week of September 24, 1988. Based on this meeting, the Department of the Environment will be taking a more active role in monitoring NRC activities and will be cooperatively working with the NRC through the State Agreements and State Liaison pregrams.

Harford County Passes Resolution on Peach Bottom Restart i On April 5,1988, the Harford County Council in Maryland adopted a resolution which requests the Governor to ask the Maryland Congressional delegation to request the Advisory Committee on Reactor Safeguards to perform an independent i review of the management and hardware problems at the Peach Bottom nuclear power facility prior to an NRC restart decision.

NEW HAMPSHIRE Meetings with New Hampshire Governor Sununu and Other State Officials On April 27, 1988, William Russell, accompanied by Dave Ruscitto, Seabrook Resident Inspector, and Marie Miller met with Governor John Sununu and various senior State officials, including David Carney, Deputy Chief of Staff; Richard Strome, State liaison Officer (SLO) and State Emergency Management Director; and Dr. William Wallace, Director, Division of Public Health Services, in Concord, New Hampshire. The Governor expressed his satisfaction with NRC Region I activities with regard to Seabrook and stated that his staff had been working to resolve the Federal Emergency Management Agency (FEMA) identified deficiencies and expected New Hampshire to have no major problems identified during the graded exercise. He also requested that NRC Region I have an observer at the State Emergency Operations Center to have a better understanding of the State Emergency Plan.

During a subsequent meeting, William Russell discussed with Dr. William Wallace and Diane Tefft, Radiation Control Program Director, and senior members of her staff, the status of the New Hampshire Agreement State Program and the status of low-level radioactive waste issues. An informal dinner, which was arranged by the SLO was also attended by NRC later that day in Manchester, New Hampshire. The meeting was attended by the SLO, the Governor's Deputy Chief of Staff, the State Treasurer, and a member of the State Public Utility Commission. The primary purpose of the meeting was to provide an opportunity for a routine exchange of information regarding NRC activities.

REGION II GEORGIA Meetino with Governor Harris and Other State Officials On April 15, 1988, Commissioner Carr, accompanied by his Special Assistant, T. Elsasser, and R. E. Trojanowski, Director, State and Government Affairs Staff, met with Governor Joe Frank Harris and other senior State officials to discuss a varietv of subjects of mutual interest to both the State and the Commission.

K,ENTUCKY Aareement State Review R. L. Woodruff, SA0, conducted a full review of the Kentucky Radiation Control Program on April 5-6, 1988, and April 18-22, 1988, in Frankfort, Kentucky.

The new Secretary for the Cabinet for Human Resources, Harry J. Cowherd M.D.,

was briefed on the A 3reement States Program and the status of the Kentucky Agreement Program. The staff determined that, overall, the Kentucky program for regul,ation of agreement materials is adequate to protect public health and safety and is compatible with the Commission's program.

GENERAL Emeroency Preparedness During the week of April 18, 1988, R. E. Trojanowski and A. Boland, Emergency Preparedness Coordinator, participated in a FEMA-sponsored Federal Radiological Emergency Response Plan Workshop in Emmitsburg, Maryland.

PEGION III ILLIN0IS 4 Enforcement Conference with Professional Service Industries, Inc.

On April 11, 1988, Region III held an enf6rcement conference with Professional Service Industries, Inc., a licensee who maintains byproduct material licenses with both the NRC and the Illinois Department of Nuclear Safety (IDNS). IDNS was represented at the meeting by Mr. Andy Gulczynski, a member of the IDNS Inspection and Enforcement Section. The meeting was held to give the licensee an opportunity to' explain the circumstances leading to the temporary loss of control of material at a Michigan job site. While the use of byproduct material in Michigan falls under the jurisdiction of the NRC, IDNS was invited to attend the meeting because the licensee's headquarters is located in Oak Brook, Illinois. The NRC presented their enforcement options to the licensee. Af ter the NRC made a determination as to which options to pursue, IDNS was informed of the NRC's position.

  • Peetina with Local Officials On April 5,1988, Carl J. Paperiello, Deputy Regional Administrator, and other Region III officials met with local officials near the Braidwood Nuclear Power Plant in Wilmington, Illinois. The meeting was held in conjunction with the Braidwood SALP meeting and was for the purpose of discussing NRC's program for regulating nuclear power plants and to encourage dialogue with local public officials.

4 Meetina with Illinois Commerce Commission On April 13, 1988, Ed Greenman, Director, Division of Reactor Projects; Dan Muller, Director, Project Directorate III-2, Office of Nuclear Reactor Regulation (hRR); Debbie Jackson, Project Engineer, NRR; and Roland Lickus, Chief, State and Government Affairs, met with the Illinois Commerce Commission (ICC)inChicago, Illinois. The purpose of the meeting was to continue a dialogue with the ICC on issues of mutual interest. Topics covered included Region Ill meetings with local public officials in ;onjunction with SALP meetings, NRC's recent reorganization, the Resident inspection and SALP programs, and the status of Braidwood 2 relative to full power licensing.

The meeting was cordial and produced many questions on a wide variety of topics. The Commissioners present felt that the meeting was beneficial and expressed interest in visiting the Region III offices again if we hold a similar meetinc in the future.

ASME Code MOU Negotiations continued with IDNS representatives on final wording for a proposed ASME Code MOU with Illinois. Agreement was reached on the proposed wording, and the M0li is being prepared for submittal to the Commission.

IOWA New SLO Governor Branstad has appointed John Eure to replace Andrew Varley (who left State government) as SLO to the NRC. Mr. Eure is currently Assistant to the Division Director for Environroental Health, Iowa Department of Public Health.

OHIO Tour of Contaminated Sites On April 19-21, 1988, Messrs. Shafer, Wiedeman, Lickus, France (Region III),

and Rouse (NMSS) toured four licensed contaminated sites in the State of Ohio i to meet with key licensee representatives and to determine the status of decontamination of these facilities. Mr. Robert Quillin, Ohio's Radiation ,

Control Program Director, attended these site visits and invited local County l Board of Health representatives who participated in all of the tours except i the Victoreen site in Cl veland. The other sites that were visited are Chemetron/McGean (Cleveland), Shieldalloy Metallurgical Corporation (Cambridge), and Vistron (Lima). The State representatives appreciated the invitation to participate in the NRC tour.

4 REGION IV KANSAS Legislative Activity The Kansas legislature adjourned in late April for 1988 without approving two bills that NRC was following--House Bill 2936, which would have created the position of State nuclear safety engineer, and Senate Bill 750, which would have required the Department of Health and Environment to establish radioactive emission standards for the Wolf Creek plant.

LOUISIANA

_ Commissioner Carr's Visit On April 27, in conjunction with a visit to'the River Bend and Waterford plants, Commissioner Carr, accompanied by John Montgomery, Deputy Regional Administrator, and other NRC officials, met with a nurrber of officials in the State Department of Environmental Quality, including the Departmental Secretary, the Assistant Secretary with responsibility for air quality and nuclear energy, and the Administrator of the nuclear energy division. The discussions centered on the Department's organization, its resources, and its conduct of a variety of programs of interest to NRC. On May 2, State officials accompanied the Connissioner on a tour of Source Production and Equipment Company, a manufacturer of radiography sources and devices and a licensee of the State.

NEBRASKA Leoislative Activity The Nebraska legislature approved, and Governor Orr signed, Legislative Bill 1092, which recuires: (1) comunity support "to the extent possible" for a low-level radioactive waste disposal facility; (2) the formation of nine-member local monitoring committees in the vicinity of proposed sites; (3) the disposal of Class C waste in monitorable and retrievable containers; and (4) a mechanism to compensate property owners in the vicinity of a facility should their property decrease in value as a result of the construction and I operation of the facility. Nebraska was selected in December 1987 as the State in which a disposal facility will be located to serve the Central waste compact.

The other States in the compact are Arkansas, Kansas, Louisiana, and Oklahoma.

TEXAS Radiation Control Prooram Review In April, Robert Doda, SAO, with assistance from SLITP and NMSS, completed the periodic evaluation of the State's programs for radioactive materials and uranium mills. The staff found that the programs are adequate to protect public health and compatible with NRC's regulatory programs. The Sta w was  :

decisions regarding the matter. l

Waste Siting Studies The Texas Low-Level Radioactive Waste Disposal Authority announced that it will begin detailed studies of its preferred site in Hudspeth County in West Texas this June. The Authority was sued in April by El Paso County which claimed in its suit that the Authority failed to conduct a balanced comparative study of available lands to arrive at its preferred site. The State legislature in 1985 directed the Authority to give preference to State-owned lands, the majority of which lie in West Texas.

South Texas Project Emergency Plan FEMA informed NRC in April that it had conditionally approved the State and local emergency plans developed in support of the South Texas Project plant.

FEMA's approval was conditional since its review of the alert and notification system is pending.

GENERAL Rocky Mountain Weste Compact--April Meeting The Rocky Fountain Low-Level Radioactive Waste Board (Colorado, Nevada, New Mexico, and Wyoming) met in Denver on April 6. The Board (1) gave conditional approval to EPA to export radium waste to a Clive, Utah, disposal site in 1988 and 1989 provided that a site within the Pocky Mountain region does not become available (EPA estimates 116,000 cubic yards of radium-contaminated waste will be generated durino the cleanup of some 44 Superfurd-listed properties in the Denver area); (2) agreed to provide

$107,500 in matching funds to assist Colorado in its efforts to develop a facility to replace the Beatty, Nevada, site; and (3) rejected a contract proposal from the State of Vennont to send its non-reactor waste to the Beatty site.

REGION V CALIFORNIA Task Force on California Nuclear Emergency Response Af ter a year-long study, the Senate Task Force on California Nuclear Emergency Response has released its final report. The Task Force was established to "formulate a report on the State of California's present medical and emergency response capacity in the event of a major nuclear facility accident, including recomendations as to how the state might improve this capacity and limit damage from, or limit exposure to, radiation in the event of such an accident."

The Task Force studied data related to the Chernobyl accident, reviewed '

emergency plans for California's three comercial nuclear power stations, and listened to members of the public living near the facilities. Task Force subcomittees focused on the issues of medical response, emergency response management, and public education /information.

The final report includes 31 specific recommendations aimed at improving the Stcte's capability to respond to a nuclear emergency.

Visit of California Radiation Control Program A visit (between formal reviews) was performed at the California radiation control program on April 18-22, 1988. The program was found to be functioning well. There has been significant staff turnover, and the State is actively recruiting. Mr. Paul Szalinski has been appointed Chief of the Radiologic Health Branch in the Department of Health Services. He reports for duty on June 1, 1988.
