APPUCATION FOR AMENDMENT TO OPERATING UCENSE The New York Power Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating Ucense DPR-50 for the James A. FitzPatrick Nuclear Power Plant. This application is filed in accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulations.

The proposed amendment to the James A. FitzPatrick Technical Specifications proposes to increase the authorized maximum power level by approximately 4.1 percent to 2536 megawatts thermal from the current limit of 2436.

The analyses and evaluations supporting these changes were completed using the guidelines in General Electric Topical Report NEDC-31897P A ' Generic Guidelines for General Electric Boiling Water Reactor Power Uprate." Generic issues associated with power uprate were addressed for FitzPatrick in another General Electric Topical Report NEDC-31964P ' Generic Evaluations of General Electric Boiling Water Reactor Power Uprate." These reports sre proprietary and have been submitted separately to the NRC by General Electric.

The signed original of the Application for Amendment to Operat r;; Ucense is enclosed for filing. Attachments I and 11 to this application contain the prte-M changes to the Technical Specifications and the aanded Safety Evaluation.

The James A. FitzPatrick safety evaluation for power uprate is in Attachment lil, General Electric Report NEDC-32016P ' Power Uprate Safety Analysis for the James A. FitzPatrick Nuclear Power Plant." This safety evaluation complies with the guidelines of NEDC-31897P A and supplements the generic evaluations of NEDC. 31964P. In accordance with the provisions of 10 CFR 2.790, those pages of NEDC-32016P containing proprietary information (labelled "GE Proprietary Information" at the top of each page) should be withheld from public disclosure. Attachment IV is General Electric's affidavit attesting to the proprietary nature of this infomtation.
