Box 26666 Richmond, VA 23261 Gentlemen: SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS. 50-338/85-28 AND 50-339/85-28) This refers to the inspection conducted at the North Anna facility of activities authorized by NRC Operating License Nos. NPF-4 and NPF-7 on October 28 through November 1, 1985. The findings were discussed with those members of your staff identified in the enclosed inspection report and at the enforcement conference held in the NRC Region II Office on December 18, 1985. The violations involve the service water intake structure for Units 3 and 4 l which when completed will also be used as a backup to the Unit 1 and 2 Service

Water Systems. The first Category I concrete pour took place on June 17, 1985. l The NRC conducted a routine inspection of construction activities on October 28 through November 1, 1985, and identified several deficiencies in the quality

assurance program for testing of soil compaction and concrete used in modifications ! of the service water intake structure. The root cause of these deficiencies appears to have been a lack of management involvement and control of the quality assurance program. In accordance with the " General Statement of Policy and Procedure for NRC , Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violations ' ' described in the enclosed Notice have collectively been categorized in i the aggregate as a Severity Level III problem. Normally, a civil penalty l is considered for a Severity Level III problem. However, after consultation with the Of rector, Office of Inspection and Enforcement, I have decided that i a civil penalty will not be proposed in this case due to your extensive corrective actions and prior good performance. l You are required to respond to this letter and should follow the instructions ' l specified in the enclosed Notice when preparing your response. In your response, l you should document the specific actions taken and any additional actions you l l

plan to prevent recurrence. After reviewing your response to this Notice, < including your proposed corrective actions, the NRC will determine whether ! further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
