Dear Mr. Reber:

This is in further response to you'r letter dated' June 12, 1985,'in which you requested, pursuant to the Freedom of Information Act (F0IA), access 'to NRC records relating to " qualification cards" of operators.

Portions of documents listed at numbers 4 through 14 on the enclosed Appendix B are being placed in the PDR. We have deleted the names of individuals the disclosure of which would constitute a clearly ur.aranted invasion of personal privacy. The deleted portions of the documents are being withheld from public disclosure pursuant to Exemption (6) of the F0IA (5 U.S.C.

552(b)(6)) and 10 CFR 9.5(a)(6) of the Commission's regulations.

The documents listed on the enclosed Appendix C are being withheld in their entirety. Document 1 contains the predecisional legal analyses, opinions, and recommendations between the Office of the General Counsel and the Commissioners and pertains to a proposed civil penalty action for Mississippi Power and Light Company regarding the Office of Investigations' investigation into alleged falsification of reactor operator license applications at Grand Gulf. Document 2 contains the predecisional analyses,-

opinions, and recommendations of the Office of the General Counsel for the Commissiont ~ ' consideration of the Office of Inspector and Auditor's report on Region II's handling of falsification of operator qualifications. These documents reflect the predecisional process between the Office of the General Counsel and the Commissioners. Both documents are exempt from mandatory disclosure pursuant to Exemption 5 of the F0IA (5.U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(L) of the Commission's regulatioris. Pelease of these documents would tend to inhibit the open and frank exchanqv ii ideas essential to the deliberative process. These documents do not c6ntain any reasonably segregable factual portions.

Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of portions of the documents listed on Appendix B are tne undersigned and Mr. J. Nelson Grace, Regional Administrator, Region II. The person responsible for the denial of the documents listed on Appendix C is Mr. James A. Fitzgerald, Assistant General Counsel of the Commission.

Any such appeal must be.in writ,ing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Conrission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denial by Mr. James A. Fitzgerald may be appealed wichin 30 days to the Secretary of the Commission and should be addressed to the Secretary of the Commission.
