Good morning, ladies and gentlemen.

-4 This is an affirmation session.

I understand we have one item 5

to bring before us this morning.

Before I ask the Secretary to 6

discuss that item, do any of my fellow Commissioners have any 7

comments to make?

9 CHAIRMAN ZECH:

If not, Mr. Secretary, proceed, 10 please.

11 MR. CHILK:

The subject is SECY 88-58, it is an order 12 on the TMI-II leak rate proceeding.

In this paper, the 13 Commission is asked to act on an order which completes its 14 review of the Hearing Board May 1987 decision.

That considered 15 what action should be taken concerning individuals possibly 16 involved in falsification of reactor coolant system leak rates 17 at TMI-II prior to the accident.

18 All the Commissioners have approved an order as 19 modified by Chairman Zech and Commissioner Carr, which was 20 attached to our Memorandum, which lifts the TMI re-start 21 condition, prohibiting employment at TMI-I in a responsible 22 management or operational position as it applied to all pre-23 accident TMI-II operators, shift supervisors, shift foremen, or 24 other individuals except gangs employed by the pre-TMI-II 25 supervisor of operations.

1 Commissioner Bernthal notes that while approving, he 2

would have preferred to follow the course recommended by the 3

staff in SECY 87-11, that is to continue the prohibition for 4

some operators of THI-II who may have been implicated by recent 5

allegations of sleeping on duty.

6 Would you please affirm your votes.
