7 APPENDIX A NOTICE OF VIOLATION Docket No.70-754 General Electric Company License No. SNN-960 Vallecitos Nuclear Center P,0. Box 460 Pleasanton, California 91304 During the NRC inspections conducted on March 22-30, 1988, and April 11, 1988, one violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedures for NRC Enforcement Actions, " 10 CFR Part 2, Appendix C (1987), the violation is listed below.

A.

License Condition Number 12 requires the licensee to implement, maintain, and exect.te the response measures of the Radiological Contingency Plan, as revisi.d February, 1988.

Section 7.5, of the Radiological Contingency Plan (RCP), requires self contained breathing apparatus (SCBA) cylinders to be tested as required by the VNC Respiratory Protection Program. The Nuclear Safety Manual, Volume 1, Respiratory Protection, Chapter 5, Revision 2, states in part, that all SCBA compressed air cylinders are to be hydrostatically pressure tested once every 5 (five) years.

Also, Volume III, Site Emergency Procedures, requires SCBA apparatus to be tagged after inspection.

Contrary to the above, at the time of the inspection, the SCBAs located in Building 1028 had not been hydrostatically tested since 1980 and were not tagged to indicate they had been inspected and were operable.

This is a Severity Level V Violation (Supplement VI).

Pursuant to the Provisions of the 10 CFR 2.201, General Electric Company is required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region V, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.

Consideration may be given to extending the response time for good cause shown.
