Sealed sources or source rods containing licensed material shall not be opened or sources removed or detached from source rods or gauges by the licensee, except as specifically authorized.

Sealed sources shall be tested for leakage and/or contamination at intervals not to exceed the l intervals specified in the certificate of registration issued by NRC under 10 CFR 32.210 or by an , ' 4p Agreement State. ' B. In the absence of a certificate from a transferor indicating that a leak test had been made within the intervals specified in the certificate of registration issued by NRC under 10 CFR 32.210 or by an Agreement State prior to the transfer, a sealed source or detector cell received from another person shall not be put into use until tested H ' ~Mr e 9' _ ' __ -. C. Sealed sources need not Oe't$ste#if they are in storage and'not being used. However, when they are removed from storage for use or transferred to another person, and have not been tested within the required leak test interval, they shall be tested before use or transfer. No sealed source shall be stored for a period of more than 10 years without being tested for leakage and/or contamination. w y\\ . , D. The leak test shall be capable of de'ecting the p.resence of 0.005 microcurie of radioactive material on the test sample.iflf the testieveals the presence of 0.005 microcurie or more of removable ^ contamination, a report shall be filed with the U.S. Nuclear Regulatory Commission in accordance with 10 CFR 30.50 (b)(2), and the source shall be removed immediately from service and ' decontaminated, repaired, or disposed 'of in accordance.with Commission regulations. The report shall be filed within 5 days'of the date the leak test result is knosn with the U. S. Nuclear Regulatory Commission, Region IV, Division'of Nuclear Materials Safety,' 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011-8064?The report shall specify the source involved, the test results, and i corrective action taken.g'W T'Q ,%l@g r.N ~ w _. %p i v s E. Tests for leakage and/or contamination shall be performed by persons specifically licensed by the Commission or an Agreement Stated,s perform such services. In addition, the licensee is authorized to collect leak test samples but not perform the analysis, analysis of leak test samples must be performed by persons specifically licensed by the Commission or an Agreement State to perform such services. 14. The licensee shall conduct a physical inventory every six (6) months, or at other interval appro ved by NRC, to account for all sources and/or devices received and possessed under the license. 15. The licensee is authorized to transport licensed material only in accordance with the provisions of 10 CFR Part 71," Packaging and Transportation of Radioactive Material". 16. Each portable gauge shall have a lock or outer locked container designed to prevent unauthorized or accidental removal of the sealed source from its shielded position. The gauge or its container must be locked when in transport, storage, or when not under the direct surveillance of an authorized user. i
17. Except for maintaining labeling as required by 10 CFR Part 20 or 71, the licensee shall obtain ~ authorization from NRC before making any changes in the sealed source, device, or source-device combination that would alter the description or specifications as indicated in the respective Certificates of Registration issued either by the Commission pursuant to 10 CFR 32.210 or by an Agreement State. ,

Any cleaning, maintenance, or repair of the gauges that requires detaching the source or source rod from the gauge shal.' be performed only by the manufacturer or other persons specifically license by the Commission or an Agreement State to perform such services. 19. A. If the licensee uses unshielded sealed sources extended more that 3 feet below t'he surface, the licensee shall use surface casing that extends from the lowest depth to 12 inches above the surface , and other appropriate procedures to reduce the probability of the source or probe becoming lodged below the surface. If it is not feasible to extend the casing 12 inches above the surface, the licensee shallimplement procedures to ensu' re that the cased hole is f ee of obstruction before making , measurements. N

If a sealed source or.a probe containing sealed sources becomes' lodged below the surface and it becomes apparent that efforts to recover the seaied source or probe may not be successful, the licensee shall notify the U.S. Nuclear Regulatory Commission and submit the report required by 10 CFR 30.50(b)(2) and (c). the licens'ee shall not abandon the sealed source or probe without obtaining the Commission's prior written consent. f '{ ~ L k !! i. $ 0 .7 20. Please note that as part of this amendment, in accordance with 10 CFR 30.36, effective February 15,1996, the expiration date of your license has been extended by a period of five years. Your new expiration date is stated in item 4 of the license. If you have any questions, you may contact the reviewer who signed your license at (925) 975-0250. ' Our review of the information supplied by McLane Testing indicates that the transfer of control of licensed activities described is in accordance with the Atomic Energy Act of 1954 (68 Stat. 919), including any amendments thereto. We hereby give NRC's consent to same pursuant to i 10 CFR 30.34(b). ' You should note that License Condition 20. has been added to your license relative to the maximum amount of material you may possess under the license. This licensing action was necessary to preclude you from exceeding possession limits of materials requiring that { decommissioning financial assurance be provided. Should you determine that you require possession of materialin excess of 10 CFR 30.35(d). amounts, please notify us regarding an i amendment to your license. The NRC is required to have your Taxpayer identification Number in order to make payments i (refunds). The self-addressed, stamped NRC Form 531, " Request for Taxpayer identification Number"is enclosed. NRC expects licensees to conduct their programs with meticulous attention to detail and a high standard of compliance. Because of the serious consequences to employees and the public which can result from failure to comply with NRC requirements, you must conduct your program involving radioactive materials in accordance with the conditions of your NRC license, representations made in your license application, and NRC regulations. In particular, note that you must: 1. Operate in accordance with NRC regulations 10 CFR Part 19, " Notices, Instructions and i Reports to Workers: Inspection and investigations," 10 CFR Part 20, " Standards for Protection Against Radiation," and other applicable regulations. ! 2. Possess radioactive material only in the quantity and form indicated in your license. i ' > !

, 1 ! McLane Testing -2- 3. Use radioactive material only for the purpose (s) indicated in your license. 4. Notify NRC in writing of any change in mailing address (no fee required if the location of radioactive material remains the same). 5. Request and obtain written NRC consent before transferring your license or any right thereunder, either voluntarily or involuntarily, directly or indirectly, through transfer of control of your license to any person or entity. A transfer of control of your license includes not only a total change of ownership, but also a change in the controlling interest in your company whether it is a corporation, partnership, or other entity. In addition, appropriate license amendinents must be requested and obtained for any other planned changes in your facility or program that are contrary to your license or contrary to representations made in your license application, as well as supplemental correspondence thereto, which are incorporated into your license. A license fee may be charged for the amendments if you are not in a fee-exempt category. 6. Maintain in a single document decommissioning records that have been certified for completeness and accuracy listing all the following items applicable to the license: Onsite areas designated or formerly designated as restricted areas as defined in
10 CFR 20.3(a)(14) or 20.1003. Onsite areas, other than restricted areas, where radioactive materials in - quantities greater than amounts listed in Appendix C to 10 CFR 20.1001-20.2401 have been used, possessed, or stored. Onsite areas, other than restricted areas, where spills or other unusual - occurrences involving the spread of contamination in and around the facility, equipment, or site have occurred that required reporting pursuant to 10 CFR 30.50(b)(1) or (b)(4), including areas where subsequent cleanup procedures have removed the contamination. Specific locations and radionuclide contents of previous and current burial areas - within the site, excluding radioactive material with half-lives of 10 days or less, depleted uranium used only for shielding or as penetrators in unused munitions, or sealed sources authorized for use at temporary job sites. Location and description of all contaminated equipment involved in licensed - operations that is to remain onsite after license termination. 7. Submit a complete renewal application with proper fee, or termination request at least 30 days before the expiration date on your license. You will receive a reminder notice approximately 90 days before the expiration date. Possession of radioactive material l after your license expires is a violation of NRC regulations. l l 8. Request termination of your license if you plan to permanently discontinue activities ' involving radioactive material. l l

The transaction is a disposition of bankruptcy estate assets and liabilities. No transfer of stock etc. is involved. Kenneth Battley, trustee, has agreed to the license amendment and transfer of ownership, control and responsibility. McLane Testing, a partnership comprised of S.A. McLane, S.S. McLane and M.S. Operating and Emergency procedures We willimplement and maintain the operating end emergency procedures in Appendix 11 of NUREG 1556, Vol.1 dated May 1997, and provide procedures to all gauge users and at each job site. See additional safety information i ' attached. We will control and maintain constant surveillance over gauges that are not in storage and secure stored gauges from unauthorized removal or use. , 7. Changes in Use, Possession, Location and Storage No changes in location or facility are planned. McLane Testing will occupy the same physical space and facilities as the former owner, McLane and Associates. Equipment and i procedures are being upgraded. Additional gauges and their source materials are listed in the table under item 5 and G. As mentioned above. McLane Testing will and does occupy the former McLane and Associates facility at Mlle 3.5 Kenal Spur Highway. The licensed materials will continue to be stored and used in designated areas. 8. Changes Requiring Amendment Without Change of Ownership New gauges will probably be purchased and are listed in the table of Materials to be Possessed. 9. Surveillance items and Records All surveillance requirements and records for the licensed material are current and will be current at the time of the transfer. Gauges are currently in storage or use. Most recent tests were performed in 1998. Copies are attached. Inventory, utilization and storage logs are current. 10. Records Concerning Safe and Effective Decommissioning of the Facility All records concerning safe and effective decommissioning of the facility; public dose; and waste disposal will be transferred to the new licensee. 11. Status of the Facility The facility consists of a materials lab room with a short-term (ovemight) storage cabinet and a long-term storage facility consisting of a 40-ft. stationary van with locked storage cabinet. The facility is clean. Leak test records document absence of contamination. Decontamination is not expected to occur before transfer. Operating and Emergency Procedures We will implement and maintain the operating and emergency procedures in Appendix H of NUREG-1556, Vol.1 dated May 1997, and provide procedures to all gauge users and at each job site. See additional safety information attached. I We w31 control and maintain constant surveillance over gauges that are not in storage and secure stored gauges from unauthorized removal or use. 7. Changes in Use, Possession, Location and Storage No changes in location or facility are planned. McLane Testing will occupy the same physical space and facilities as the former owner, McLane and Associates. Equipment and procedures are being upgraded. Additional gauges and their source materials are listed in the table under item 5 and 6. . As mentioned above, McLane Testing will and does occupy the former McLane and Associates facility at Mile 3.5 Kenal Spur Highway. The licensed materials will continue to be stored and used in designated areas. 8. Changes Requiring Amendment Without Change of Ownership New gauges will probably be purchased and are listed in the table of Materials to be Possessed. i 9. Surveillance items and Records All surveillance requirements and records for the licensed material are current and will be current at the time of the transfer. Gauges are currently in storage or use. Most recent tests were performed in 1998. Copies are attached. Inventory, utilization and storage logs are current. 10. Records Concerning Safe and Effective Decommissioning of the Facility All records conceming safe and effective decommissioning of the facility; public dose; and ' waste disposal will be transferred to the new licensee. 11. Status of the Facility l The facility consists of a materials lab room with a short-term (ovemight) storage cabinet and l a long-term storage facility consisting of a 40-ft stationary van with locked storage cabinet. The facility is clean. Leak test records document absence of contamination. Decontamination is not expected to occur before transfer. Decontamination Plans The transferor, McLane and Associates, is transferring all licensed source material and responsibility for any cleanup needed at the time of the transfer to McLane Testing. McLane Testing and all its partners, agree to accept the material and responsibility. 13. Transferee Confirmation The transferee, McLane Testing, agrees to abide by all commitments and representations previously made to NRC by the transferor. These include, but are not limited to: maintaining decommissioning records required by 10 CFR 30.35(g); implementing decontamination activities and decommissioning of the site; and completing corrective actions for open inspection items and enforcement actions. The transferee, McLane Testing, accepts full liability conceming licensed, radioactive source materials for the site. No financial assurance is required at this time due to the limited nature and amount of licensed source material. Material Receipt and Accountability Physical inventories will be conducted at intervals not to exceed 6 months, to account for all sealed sources and devices received and possessed under the license. Occupational Dosimetry We will maintain, for inspection by NRC, documentation of dosimetry processed and evaluated by an NVLAP-approved processor that is exchanged at a frequency recommended by the processor. McLane Testing plans to use Landauer, Inc. for dosimetry analysis. Public Dose We will ensure that licensed gauges will be used, transported and stored in such a way that members of the public will not receive more than 1 millesievert (1 mSv)[100 millirem (100 mrem)] in any one year, and the dose in any restricted area will not exceed 0.02 millesievert (0.02 mSv)[2 millirem (2 mrem)] in any one hour, from licensed operations. Leak Test Leak tests will be performed at intervals approved by the NRC or an Agreement State and specified in the Sealed Source and Device Registration Sheet. Leak tests will be performed by an organization authorized by NRC or an Agreement State to provide leak testing services for other licensees, using a leak test kit supplied by by the organization. Currently, Troxler Electronic Laboratories provides the wipe kits and does the analysis. McLane Testing does not intend to request authorization to perform Leak Testing Sample Analysis. Maintenance Routine Cleanina and Lubrication We will implement and maintain procedures for routine maintenance of our gauges according to each manufacture's recommendations and instructions. Description of Transaction McLane and Associates is currently owned by a bankruptcy estate and will no longer be conducting business using gauges with licensed radioactive source materials. Therefore M&A seeks to amend its NRC license to transfer ownership, control and responsibility of Troxler Model 34110 moisture density gauges (serial numbers: 9800, 12192 & 13650) and Troxler Model 3241 asphalt content gauge, serial no. 562 to McLane Testing.1he transaction is a disposition of bankruptcy estate assets and liabilities. No transfer of stock etc. is involved. Kenneth Battley, trustee, has agreed to the license amendment and transfer of ownership, control and responsibility. McLane Testing, a partnership comprised of S.A. McLane, S.S. McLane and M.S. McLane agrees to accept ownership, control and responsibility of the gauges and their sealed sources. 6. Operating and Emergency Procederas We willimplement and maintain the operating and emergency procedures in Appendix H of NUREG 1550, Vol. I dated May 1997, and provide procedures to all gauge users and at each job site. We will control and maintain constant surveillance over gauges that are not in storage and secure stored gauges from unauthorized removal or use. 7. Changes in use, Possession, Location and Storage No changes in location or facility are planned. McLane Testing will occupy the same physical space and facilities as the former owner, McLane and Associates. Equipment and procedures are being upgraded. Additional gauges and their source materials are listed in the table under item 5 and 6. As mentioned above, McLane Testing will and does occupy the former McLane and Associates facility at Mile 3.5 Kenal Spur Highway. The licensed materials will continue to be stored and used in desi nated areas. 0 8. Changes Requiring Amendment Without Change of Ownership New gauges will probably be purchased and are listed in the table of Materials to be Possessed. 9. Surveillance items and Records All surveillance requirements and records for the licensed material are current and will be current at the time of the transfer. Gauges are currently in storage or use. Most recent tests were performed in 1998. Copies are attached. Inventory, utilization and storage logs are current. 10. Records Concerning Safe and Effective Decommissioning of the Facility All records concoming safe and effective decommissioning of the facility; public dose; and waste disposal will be transferred to the new licensee. 11. Status of the Facility The f acility consists of a materials lab room with a short-term (ovemight) storage cabinot and a long-term storage facility consisting of a 40-ft. stationary van with locked storage cabinet. The facility is clean. Leak test records document absence of contamination. Decontamination is not expected to occur before transfer. McLane Testing, the successor company, agrees to assume full liability for decontamination of the facility. Decontamination Plans The transferor, McLane and Associates, is transferring alllicensed source material and responsibility for any cleanup needed at the time of the transfer to McLane Testing. McLane Testing and all its partners, agree to accept the material and responsibility. 13. Transferee Confirmation The transferee, McLane Testing, agrees to abide by all commitments and representations previously made to NRC by the transferor. These include, but are not limited to: maintaining , decommissioning records required by 10 CFR 30.35(g); implementing decontamination ) activities and decommissioning of the site; and completing corrective actions for open ' inspection items and enforcement actions. The transferee, McLane Testing, accepts fuli liability conceming licensed, radioactive source materials for the site. No financial assurance is required at this time due to the limited nature and amount of licensed source material. The transferee. McLane Testing, accepts full responsibility for open inspection items and/or any resulting enforcement actions. 14. SCHMIDT , On January 16. 1996, the Nuclear Regulatory Commission (NRC) amended its regulations in 10 CFR 30, 40 and 70 to extend the expiration date of certain byproduct, source, and special nuclear material licenses J by five years (61 FR 1109). The above ret. -.ced license was extended by this rulemaking and will now expire on September 30. 2003. Your license will not be amended to show this extended date until the next 2 routine licensing action. Until then, you may provide copies of this letter to vendors and other interested parties as evidence that the license has been extended as a result of the rule. The extended license authorizc;s the same activities and contains the same limitations as it previously
did. There will be no change in the frequency that the NRC inspects activities authorized by this ~ license. i The amended rules state that in the case'of licensees who are granted extensions and who have a currently pending renewal application for that extended license, the application will be considered withdrawn by the licensee and any renewal fees paid by the licensee for that application will be refunded. This will apply to licenses with expiration dates after July 1. 1995, for which renewal applications and the appropriate fees have been submitted and the renewal is stP1 pending. Refunds will be mailed to licensees under separate cover. ' All licensees, including those whose renewal applications were withdrawn by this rulemaking, who wish to change their radiation safety programs must request amendment of their licenses to reflect these changes. Amendment requests must include the correct amendment fee since the NRC cannot apply pending renewal refund balances toward amendment fees.
