FEBRUARY 14, 1986, 01 REPORT OF INVESTIGATIONS ONFERMI2(3;tj013)
On February 12, 1986, I requested a copy of che above report froc the Director, Office of Investigations to detemine if there was a safety issue that needs to be addressed by the staff prior to the restart of Fermi 2.
By memorandum dated February 21, 1986, I received the report entitled "Material False Statements Regarding Full Power Licensing." Upon receiving the report, I requested various segments of the staff to review the report to detennine what action, if any, needs to be initiated by the NRC before the Fermi 2 reactor is pemitted to restart. The Executive Legal Director infomed me on February 28 that based on their preliminary review they found
- nsufficient evidence to support the report's conclusions regarding willfulness and intent for various individuals.
I will be meeting with senior members of my staff later this week to outline various staff actions in response to various investigations regarding the Fermi 2 July 1,1985 cperator error.

I will provide you with the sumary of the conclusions reached after the meeting.

Purpose:
To infom the Cmmissioners of the circunstances surrounding the suspension of the MC license of Radiation Technology, Inc., (Kr!) and to explain the subsequent conditional lif ting of the suspensicn. The Cannissioners should note that the licensee has requested a hearing which has been referred to the Secretary for initiation of the hearing process.
Discussion:
Radiation,, Technology, Inc., has been licensed to operate a 3
1srge irradiator hear Rockaway, New Jersey since Novenber 1970. The licensee's irradiator uses sealed cobalt-60 sources to produce high intensity gama ray fields for the sterilization of medical equipnent and supplies and for 1
various other industrial and scientific applications.
In addition, the licensee has long sought FM approval to irradiate food products for routine consunption. Martin A.
Welt, Ph.D., is President, Chairman of the Board of Directors and the Radiation Safety Officer for Kr'.
Rr! also owns and operates irradiators through t olly om ed subsidiaries in North Carolina and Arkansas, both Agreanent States. Another tolly owned subsidiary, South Jersey Process Technology, built an irradiator in Satan, New Jersey which was licensed by Region I cn March 14, 1986.
The following description of events leading to the suspensicn is taken fran Sections III 6 IV of the March 3, 1986 Order Suspending License.

t In addition, contrary to the licensee's ccanitment to I
operate facility in strict accordance with the license as described in the above Confimatory Action Letter, the licensee replaced the approved conveyor interlock systen wi.th _a new system in October or November 1985, and subsequently operated the irradiator, without infonning the
?mC and obtaining the required approval. A license anandnent request and approval are required to pennit the
?RC to ensure that operation of the replacanent interlocks would be in accordance with regulatory requiracents.
Approval was not requested intil January 9,1996, and approval has not yet beer, granted. On the basis of these facts, the Order suspending Rr!'s license was issued on March 3, 1986.
Subsequently, the licensee requested lif ting of the suspensicm by letters to the NRC dated March 4 and 5,1986.
Af ter the NRC staf f met with the licensee on March 6, a more ecmplete submission was provided by the licensee on March 10. This latter submission proposed interim plant operations under the supervisicm of an independent
'Ihird Party, reporting directly to a menber of the Rr!
Board of Directors, h, along with the licensee, would be responsible for assuring that the facility would be operated safely yx1 in ecznpliance with all NRC requirements.
Further, an indepen8ent Fourth Party would monitor the activities of the Third Party on a weekly basis. Both j
parties would provide reports simultaneously to the licensee and to the bmC. Following consideration of this proposal and agreenent of the licensee to additional item, the staff concluded that tanporary restaption of facility operaticms truier these conditions would not endanger the health and safety of the public. Accordingly, a Canditional Rescissics of the Order Suspending License ma issued on March 13, 1986. The licensee agreed to the temas of this Order in a letter dated March 13, 1986 (Enslosure 4).
Sehsequently, on March 14, 1986, Region I issued a license to the Salen, New J rsey irradiator f acility owned by the j
subsidiary of Rrl. Due to the problens identified at the Rockaway f acility, special attenticm was given to the smangement structure responsible for the operation of the Enlas facility and ccanitments were received frczn the licensee and incorporated into the license that personnel meer investigaticm would not be involved in controlling en use of licensed material. ]
Ch March 17, 1986, the licensee requested relaxation of te tenns of the Conditional Rescission of the Order (Enclosure 5), relaxation of the license conditions teamed with the Salen license on March 14, 1986 (Enclosure 4), and requested a hearing on the original Suspension Order (helosure 7).

The licensee's most recent subnittals are being reviewed; however, the staff renains convinced at this time that the additional organization features reqcired by the March 13, 1986 Conditional Rescission of Order Suspending License, are necessary to provide reasor.able assurance that the f acility will be operated in confonnanes with NRC requirenents.
