COMMISSIONER McGAFFIGAN'S COMMENTS ON SECY-98-165. "Procosed Revision to 10 CFR 50.65(a)(3) to Reauire Licensees to Perform Safety Assessments (Notation Vote)"

l I approve the staff's recommendations subject to the following comments.

I agree with the coment by Comissioner Diaz that the intent of paragraph (a)(4) is to allow licensees the flexibility to use either probabilistic or deterministic methods when performing the safety assessments required by this subsection.

I believe that clarification on this point would be more appropriate l

in the implementation guidance than in the rule itself.

The staff may wish to consider soliciting public coment on this point in the Federal Reaister notice.

I encourage the staff to work in a collaborative fashion with industry representatives--in meetings that are open to the public--to develop a revision to NUMARC 93-01 that establishes acceptable implementation guidance for the proposed rule change.

I would hope that the staff would also be able to propose endorsing the revision to NUMARC 93-01 in Revision 3 to Regulatory Guide 1.160 at the time the final rule is presented to the Commission, not 120 days later as proposed by the staff.

STAFF REQUIREMENTS - SECY-98-165 - PROPOSED REVISION TO 10 CFR 50.65(a)(3) TO REQUIRE LICENSEES TO PERFORM SAFETY ASSESSMENTS l

The Commission has approved publication of the proposed rule in the Federal Reaister for a 75-j day comment period. The staff should ensure that the statements of consideration and the implementation guidance to be developed as discussed in the next paragraph provide sufficient clarification that licensees be given the flexibility to use appropriate probabilistic and/or deterministic methods when performing the safety assessments required by subsection a(4).

The staff should solicit public comment in the Federal Reaister notice on whether any further clarification of this point should be provided in the rule.
