REQUEST FOR INVESTIGATION OF GENERAL ELECTRIC (NEBO)
CORPORATION REGARDING THE ALLEGED VICO TIONS OF 10 CFR PART 21 I am in receipt of the SUBJECT memo dated January 22,19EL.
I concur with your assessment concerning the substance of the allegatiers.
Also, it should be noted that this matter was reported to the NRC in Octeber 1985, and was not brought to 01's attention until November 1987.
The events in question occurred between 1978 and 1982 and would not be within the generai civil statute of limitations.
The questionable substance of the allegations, the staleness of the infomation, and the likelihood that the statute of lir,itations has probably l
lapsed causes me to see no investigative merit into this matter at this time.
I If the NRC inspectors discover more current infomatior. concerning defective materials, we could then reevaluate the merits of opening an inquiry.
Based on all conditions of this matter, I would decline initiating an investigation.
All infomation concerning this matter is being returned to you and is attached with this memo.
