APPLICATION FOR AhlENDhlENT TO OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, the New York Power Authority, as holder of Facility Operating License No. DPR-59, hereby applies for an Amendment to the Technical Specifications contained in Appendix A of this license.
This proposed amendment to the James A. FitzPatrick Technical Specifications is necessary to support plant start-up and operation after the Reload 8/ Cycle 9 refueling outage. 184 fuel bundles in the reactor core are to be replaced with new fuel bundles during this outage.
The changes to the Technical Specifications involve deleting specifications associated with the discharged fuel and with Cycle 8 specific analyses, and replacing them with specifications appropriate for the new fuel and which are based on Cycle 9 specific analyses.
The proposed amendment changes Technical Specification nages pages vii. 7,12,13, 31, 43a, 47a, 47b,123,130,135h, and 245, and adds two new Figures, 3.5-13 and 14, on new pages 135k and 135L.
Enclosed for filing is the signed original of a document entitled "Application for Amendment to Operating License," with Attachments I, II, Ill, and IV thereto, comprising a statement of the proposed changes to the Technical Specifications, the associated Safety Evaluation, and two (2) reports from the General Electric Company.
The two reports are entitled: "Supplemental Reload Licensing Report for James A.
FitzPatrick Nuclear Power Plant - Reload 8 (Cycle 9)," and "James A. FitzPatrick 1
Nuclear Power Plant SAFER /GESTR-LOCA Loss-of-Coolant Accident Analysis -
Errata and Addenda No. 2."

2 " included as Attachment IV to this application contains information which General Electric customarily maintains in confidence and withholds from public disclosure.
This informstion has been handled and classified as proprietary to General Electric as indicated in the affidavit previously submitted to the NRC as Attachment V to Reference 1, and the Authority hereby requests that this report be withheld from public disclosure in accordance with the provisions of 10 CFR 2.790.
