Gentlemen:

SUBJECT: NRC INSPECTION REPORT N0. 50-424/87-57

Thank you for your revised response of March 11, 1988, to our Notice of

Violation, issued on November 5,1987, concerning activities conducted at your

Vogtle facility.

This letter also documents the meeting between NRC Region 11 personnel and

Georgia Power Company (GPC) personnel, which was held in the Region II office

on March 25, 1988, to discuss Violation B of the subject inspection report. A

list of meeting attendees is enclosed.

After careful consideration of the bases for your denial of Violation B, we

have concluded for the reasons presented in previous NRC correspondence on

this matter and as explained at the March 25, 1988 meeting, that the violation

occurred as stated in the Notice of Violation. We recognize that your

position was based on the understanding that only failures that affected

surveillance frequencies were to be considered reportable failures.

Nevertheless, as discussed, all failures are considered to be reportable,

thereby requiring a special report to be submitted for the unsuccessful start

attempts listed in the Notice of Violation. At the conclusion of the March 25

1988 meeting, Georgia Power Company personnel acknowledged the violation and stated

that a special report will be submitted by April 25, 1988, concerning these

unsuccessful start attempts. They also stated that methods used to determine

reportability will be modified so that all start failures will be reported

as required. We will examine the implementation of your corrective actions

during future inspections.
