Dear Sir:

This application proposes to revise Section 4.6.G.1 ("Jet Pumps") of the James A. FitzPatrick Nuclear Power Plant Technical Specifications to correct a typographical error. NRC Inspection Report 78-05 (Reference 1) identified a conflict in Section 4.6.G.1 and the corresponding bases section. The change proposed by this application resolves the conflict by revising Section 4.6.G.1 on page 145 to agree with the corresponding bases.

Section 4.6.G.1 specifies surveillance requirements to verify jet pump performance.

Enclosed for filing is the signed original of a document entitled "Application for Amendment to Operating License," with Attachments I and II thereto, comprising a statement of the proposed changes to the Technical Specifications and the associated Safety Evaluation.

In accordance with 10 CFR 170.12, a check in the amount of

$150.00 is enclosed as payment of the application fee for the review of the proposed changes to the Technical Specifications.

In accordance with 10 CFR 50.91, a copy of this application and the associated attachments are being provided to the designated New York State official.

APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, the New York Power Authority, as holder of Facility Operating License No. DPR-59, hereby applies for an Amendment to the Technical Specifications contained in Appendix A of this license.

The application proposes to revise Section 4.6.G.1 to correct a typographical error. NRC Inspection Report 50-333/78-05 identified a conflict in Section 4.6.G.1 and the corresponding bases section. The change proposed by this application resolves the conflict by revising Section 4.6.G.1 to agree with the corresponding bases. Section 4.6.G.1 specifies surveillance requirements to verify jet pump performance.

Section 4.6.G.1 (page 145) is revised to reduce the maximum permissible recirculation loop flow imbalance from 15 to 10 percent. The 10 percent value is consistent with the Technical Specification bases, NRC staff, and industry guidance.

The proposed changes to the Technical Specifications are Attachment I to this Application for Amendment to the Operating License. The Safety Evaluation for the proposed changes is included as Attachment II.
