B. Purpose of Investication
- 1. What is the basis for the belief that the violation of a regula-tory requirement is more likely to have been intentional or to have resulted from careless disregard or reckless indifference than from error or oversight?
i Dow Corning, who made changes to the formulation of their silicone i seal material, was made aware of test failures in which their sili- i cone seal system was used by Transco. It was also common industry knowledge that ANI had withdrawn their approval of the Dow Corning fire seal system for 9" seals. Allegedly the NRC also made inquiry of this change and its effect on the seals performance, but Dow Corning never filed a Part 21 or made required notification to the NRC or the nuclear industry.
