SUBJECT:

TELECON WITH DUKE POWER COMPANY'S STAFF REGARDING A VERBAL TEMPORARY WAIVER OF COMPLIANCE ON DIESEL GENERATOR SURVEILLANCE RE0VIREMEN1-MCGUIRE NUCLEAR STATION, UNITS 1 AND 2 i

At about 4:25 p.m. on July 15, 1988, Duke Power Company staff (Robert Sharpe, et al.) in the presence of David Nelson, NRC Resident Inspector at McGuire, cdlled David Matthews and Kahten Jabbour (NRC/NRR) to request an emergency Technical Specification change.

At about 12:16 p.m. on July 15, 1988, DPC's staff had concluded that it was not possible to demonstrate compliance with Diesel Generator (DG) Surveillance Requirement 4.8.1.1.2.e.6)c) because I

there are four DG trips not automatically bypassed in the design rather than three. Duke's staff stated that initially this appeared as a missed surveil-lance but then they judged that, given the additional time, they still can not j

meet that TS Surveillance as presently written.

Thetifore, they concluded that the TS should be changed and they requested a temporary waiver of compliance until the TS is changed.

They stated that the DGs are operable because the procedures used to test them were based upon the correct design, d1though inconsistent with the TS Surveillance Requirement, and the results demonstrate their operability. The wording of the TS Surveillance Requirement should be changed to make it similar to the wording that exists in the Catawba TS which reflects the design for both Catawba and McGuire.

David Matthews agreed that this event should not be considered as a missed surveillance. He recognized that the DGs are operable and, therefore, granted a teMpordry Waiver of compliance.
