NOTICE OF VIOLATION  ;

r I Jose R. Garza IA 97-038 I i During an NRC investigation completed April 8,1997, a violation of NRC requirements was )

identified in accordance with the " General Statement of Policy and Procedure for NRC I Enforcement Actions," NUREG-1600, the violation is listed below: j l

10 CFR 50.5(a)(1) states, in part, that any licensee employee may not engage in deliberate misconduct that causes or, but for detection, would have caused, a - i l licensee to be in violation of any rule, regulation, or order issued by the l l Commission. i 10 CFR 50.5(c) states, in part, that deliberate misconduct by a person means an intentional act or omission that the person knows constitutes a violation of a j requirement, procedure or policy of a licensee. '

Licensee procedure SO123-XV-24, step 6.5.1, Revision 2, requires, in part, that

! licensee employees granted unescorted access to the protected area report all arrests or convictions. -

i Contrary to the above, as of February 1997, Jose R. Garza, an employee of l Southern California Edison (SCE) who was granted unescorted access to the San

  • Onofre Nuclear Generating Station, was aware of the above procedural requirement and deliberntely failed to notify SCE of his arrests and convictions for driving under the influenca of alcohol in 1994 and 1996.  ;

P This is a Severity Level 111 violation (Supplement 1).

The NRC has concluded that information regarding the reason for the violation and the I corrective actions that you have taken and are taking to prevent recurrence are adequately I addressed in the transcript of the July 18,1997 conference and in this letter. Therefore, you are not required to respond to this Notice unless you plan to contest it or provide i additional information, in which case you should follow the instructions below, if you -

choose to respond, clearly mark your response as a " Reply to a Notice of Violation", and i send it, within 30 days of the date below, to the U.S. Nuclear Regulatory Commission, l l ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional  !
