BOARD NOTIFICATION NO. 83 IMPOSITION OF CIVIf PENALTY In accordance with present NRC procedures regarding Board Notifications, we are providing you with the attached Notice of Violation and Proposed Imposition of Civil Penalty regarding Shoreham. This action is based upon the applicant approving preoperational test results for a diesel generator test even though the test results indicated that one of the test acceptance criteria was not satisfied.
The staff does not consider that the imposition of this civil penalty is inconsistent with its testimony in the Shoreham proceeding and does not see that any changes to the Shoreham Safety Evaluation Report or its supplements are necessary. The applic:nt has thirty days to respond to the Notice, and we will provide the Board with any additional information we receive.
