HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING APRIL 8, 1988 Bilateral Nuclear Safety Cooperation with the U.S.S.R.

On Wednesday GPA participated in an interagency meeting to coordinate plans for the April 25 - May 3 visit of a Soviet delegation of senior atomic energy officials. Current plans for the visit include tours of DOE and NRC-licensed facilities, and discussions at the Department of State of U.S.-Soviet cooperation in the peaceful uses of atomic energy. During this visit, Chairman Zech plans to sign a 5-year Memorandum of Cooperation between the U.S. and the U.S.S.R. in the field of nuclear safety.

Reactor Operations Analysis Branch At the request of NRR, an AEOD/ROAB staff member participated with NRR and Region III in an NRC visit to the Braidwood site to discuss issues raised by the discovery of mixed grease in the gear box of Limitorque valve actuators.

The guidance provided by AE0D related to MOV operability assurance and methods to monitor for changes in MOV operating characteristics that may result if the grease degrades. We also suggested that the licensee's statement that grease softening would not be a problem, based on a consultant's report, was not supported becsuse operating experience has shown hydraulic lockups due to the less viscous grease.

An Engineering Evaluation concerning recent BWR overfill events resulting in steam line flooding events is expected to be issued soon. The study found that although many potential safety concerns exist due to these events, operating j experience indicates that these events are infrequent and have had little actual safety significance. However, because some licensees have had difficulty identifying or assessing all potential safety concerns resulting from these events, the NRC should monitor closely licensee actions to ensure that all such concerns are considered and resolved following these type events.

Harford County Passes Resolution on Peach Bottom Restart On April 5, 1988, the Harford County Council in Maryland adopted a resolution which requests the Governor to ask the Maryland Congressional delegation to request the Advisory Comittee on Reactor Safeguards to perform an independent review of the managec nt and hardware problems at the Peach Bottom nuclear power facility prior to an NRC restart decision.

Meeting With EPA On Mixed Waste On April 7,1988, LLWM staff met with EPA to review the status of the mixed l LLW issue, to define priorities for the remaining tasks, arid to eitablish i schedules for various guidance to be jointly issued by NRC and EPA in FY88.

Senior Vice President of Generation and Transmission announced his resignation, effective immediately. According to AP&L sources, Mr. Griffin has decided to pursue other business opportunities.

The Senior Vice President of Generation and Transmission has the nuclear program as one of his responsibilities. Until a successor is named, Mr. T. Gene Campbell, Vice President of Nuclear will report directly to the President and Chief Executive Officer of AP&L.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending April 8, 1988 INDUSTRIAL AND MEDICAL NUCLEAR SAFETY FUEL CYCLE SAFETY Fuel Cycle Safety Dry Spent Fuel Storage On April 1,1988, NRC staff received a license application for dry spent fuel storage under 10 CFR Part 72 from Duke Power Company for its Oconee Nuclear Station site. Duke proposes to store fuel in a NUTECH Horizontal Modular StorageSystem(NUHOMS-24P). The Topical Report for this concrete module and stainless steel canister storage system design was recently submitted to NRC staff for safety review (docketed under Project No, M-49). This design is similar to that previously approved for the CP&L Robinson site, except for an increase in the module capacity from 7 to 24 PWR assemblies, and an increase in the decay period for the fuel to be stored from 5 to 10 years. The Duke Power design is also based on credit for fuel burnup for criticality safety purposes.

The design includes a shielded onsite transfer cask for movement of the loaded canister from the reactor basin to the concrete storage module. The Duke application is for up to 88 modules, enough capacity for the operating life of the Oconee Nuclear Station. However, initial construction would include only 10 modules.

Babcock & Wilcox Naval Nuclear Fuel Division - Lynchburg, Virginia NMSS staff met with B&W representatives on April 6, 1988, to discuss a pending license amendment to revise the definitions of controlled and uncontrolled areas in the license. Product specifications for contamination levels will be removed from the license and new limits, based on guidance in RG 8.24, will be the basis for revised license conditions.

LOW-LEVEL WASTE MANAGEMENT Low-level Waste Meeting With EPA On Mixed Waste On April 7, 1988, LLWM staff met with EPA to review the status of the mixed LLW issue, to define priorities for the remaining tasks, and to establish schedules for various guidance to be jointly issued by NRC and EPA in FYC8.

2 Decomissioning DOE Briefing On Shippingport On April 6, 1988, DOE representatives of the Office of Remedial Action & Waste Technology briefed the HMSS staff on the Shippingport Station Decomissioning Project. The briefing provided an overview and status of the Project with a focus on the development of unconditional release limits and the proposed plan for their implementation.

HIGH-LEVEL WASTE MANAGEMENT Observation of DOE Audit of Holmes & Narver During the week of March 27,1988.the DHLWM staff perfonned and observed a DOE field office audit (00E/WMP0 audit 88-02) of Holmes & Narver (H&N). H&N is the architect engineer for the surface facilities for the high-level waste repository.

The purpose of the observation audit was to assess whether DOE's audit program is effective and meets NRC's quality assurance (QA) requirements. The staff will issue a sumary report which describes its observations of the audit. In short, the NRC staff considers that a thorough programatic audit was performed by the Waste Management Project Office and that potentially significant prob' 's were identified by the audit team. The major issues identified by the DOE a, ..t team relate to the need for H&N to expand its training in the QA area and to increase the number of QA staff devoted to NNWSI activities. The NRC staff agrees with these observations.

Nineteenth Meeting of the Radioactive Waste Management Comittee l

On March 29-31, 1988 NMSS staff participated in the nineteenth meeting of the Radioactive Waste Management Comittee (RWMC) in Paris, France. The RWMC is a management comittee for international waste management activities, sponsored by the Nuclear Energy Agency (NEA) of the Organization for Economic Cooperation and Development. Representatives of DOE were also in attendance and led the U. S. delegation. The Comittee discussed a broad range of actions that have been undertaken or that have been proposed by working groups that serve the RWFC in an advisory capacity, notably the Perfonnance Assessment Advisory Group (PAAG) and the In-Situ Advisory Group (ISAG). A number of these activities directly result from initiatives of NMSS staff that participate in these working groups.

Examples are (1) the establishment of a special working group under the PAAG on scenario development for waste repositories and (?) the initiation of a workshop on near-field sorption for low-level waste repositories. The RWMC expressed support'for these NRC initiatives.

OFFICE OF NUCLEAR REGULATORY RESEARCH Items of Iriterest Week Ending April 8, 1988 WASTE MANAGEMENT Conference on "Mathematical Modellino of Fate, Transport and Effects of Pollutants in the Environment On Tuesday, March 29, 1988, Dr. John D. Randall, RES/DE/WMB, gave an invited presentation entitled "Some Modelling Problems Associated with the Subsurface Transport of Radionuclides from Buried Radioactive Waste," to a conference on "Mathematical Modelling of Fate, Transport and Effects of Pollutants in the Environment" at Cornell University in Ithaca, NY. The conference was organized by Cornell's Centers for Applied Mathematics and Environmental Research.

Topics discussed in Dr. Randall's presentation were radioactive waste classifications and associated periods of regulatory concern, the status of l modelling of corrosion of waste packages, a summary of characterization and j modelling of groundwater flow and radionuclide transport through saturated 1 fractured rocks, an outline of mathematical modeling problems associated '

with modelling groundwater movement in unsaturated fractured rocks, a brief description of a model calibration and validation exercise at Chalk River in Canada, and a discussion of the need to couple models of chemical phenomena with models of radionuclide transport.

Topics discussed by other speakers at the conference included transport of contaminants through macropores, numerical analysis techniques applied to contaminant transport, the use of boundary integral methods to predict groundwater flow and contaminant transport through discrete fracture networks, stochastic modelling of subsurface contaminant transport, solute leaching in soils, optimization techniques applied to remediation of l groundwater contamination, nonlinear programming applied to groundwater quality control, modelling of atmospheric turbulent transport of contaminants, global modelling of tracer transport and dispersal in the atmosphere, regional-scale atmospheric pollution models, the use of expert systems in EPA's regulatory process, remote sensing of ocean pollution, models of exotoxicology, effects of toxicants on aquatic populations, and an assessment of the reliability of models of pollution effects in forests.

Status of ECCS Rule Revision 1 On March 3, 1987, the NRC published proposed amendments to 10 CFR 50.46 and Appendix K that would permit applicants and licensees to use realistic l calculations of emergency core cooling system response to loss of coolant <

accidents when detemining the acceptance criteria in 10 CFR 50.46 (b) l' (e.g., calculated peak cladding temperature less than 2200'F) are not exceeded. The rule requires licensees who avail themselves of the new I provisions to perform an uncertainty analysis and to use this estimate to  !

provide assurance with a high level of probability that the plant is l operating in such a manner that the acceptan:e criteria will be met. I Thirty-three coment letters were received and the coments were generally favorable to the approach taken. The comenters favored grandfathering existing Appendix K modelling. The comenters were opposed: to incluJing an explicit degree of conservatism to be applied to the evaluaticn model; to explicit prohibition of power uprating until all severe accident and unresolved safety issues are resolved; and to having the technical basis of the rule reviewed by an independent group such as the American Physical l Society. The staff has considered and resolved all of the public coments i and has prepared a Comission Paper package recomending the issuance of the '

l rule with no substantive changes from the proposed rule.

This proposed rule as well as all of the supporting documentation is  !

expected to be circulated to the other offices for final concurrence within the next few weeks.

Definition of High-level Radioactive Waste (HLW) in 10 CFR Part 60/Part 61 ,

XInenaments I i

The Comission instructed the staff to analyze the need to revise the definition of high-level radioactive waste in Part 60 to confom with the definition in the Nuclear Waste Policy Act (NWPA). An ANPR was published on February 27,1987 (52 FR 5992), which recomended a revision based either wholly or partially on concentrations of radionuclides in the waste. After )

assessing the public coments on the ANPR, and also taking into account recent information, the staff is now recomending against any revision of the definition of HLW. Instead, amendments to Part 61 are being recomended that would require geologic repository disposal of all above Class C low-level radioactive waste (LLW) unless an alternative has been approved by the Comission.

This would accomplish the objective of establishing suitable disposal requirements for radioactive waste.

The proposed rulemaking package was forwarded to the EDO on February 5, 1988, and to the Comission on February 19,1988(SECY-88-51). The staff met with Comissioners' assistants on March 29, 1988. The detailed analysis of public coments was completed and delivered to the EDO on March 30, 1988. ,

It will be placed in the Public Document Room after Comission action on l SECY-88-51.

3 Safety Requirements for Industrial Radiographic Exposure Devices (10 CFR 34)

The proposed rule would amend the present regulations to establish performance standards for industrial radiography exposure devices.

Overexposures of radiographers (and occasionally the general public) are more than double that of other radiation workers and have been a concern to the NRC for some time. Approximately 40 percent of the radiography I overexposures are associated with equipment malfunction. The issue of 1 safety requirements for these devices is a primary concern since the devices use relatively high intensity, high energy gamma-ray emitting sources with the potential for serious overexposures. Although a consensus standard for radiographic exposure devices was published in 1981 (American National Standard N432), it is not clear that all manufacturers are adopting the standard.

The proposed rule was published in the Federal Register on March 15, 1988 (53 FR 8460). The public connent period is scheduled to end May 16. 1988.

Nonreactor Assessment Staff A NAS staff member attended a meeting with NMSS, RES, OE and others to discuss changes to 10 CFR Part 20.403. The meeting was requested by OE and NMSS because of problems steming from the Wright-Paterson AM 241 contamination event. The  !

changes being discussed are intended to clarify what events are reportable. The j intent of RES activities would be to proceed for an instent rule. Our staff l member pointed out that all of Part 20 is applicable to reactors.

Trends and Patterns Analysis Branch The first quarter CY 88 Report to Congress on Abnormal Occurrences has been drafted and should be issued for staff review next week. A high percent of the content will be events that actually occurred in the fourth quarter of CY 87 that, following detailed analysis, were detertnined to be reportable. Further staff action on A0 reportability seems necessary to improve on timeliness.

Incident Response Branch On April 4 the Incident Response Branch (IRB) staff participated in a demonstration of a state-of-the-art display system for potential upgrading of the Executive Team video wall monitor. IRB staff will continue to evaluate the upgrade effort as one of several initiatives directed at upgrading the NRC j Operations Center.

APRIL 8, 1988 ENCLOSURE E

On April 7, IRB staff met with the Source Evaluation Panel (SEP) to review the technical evaluation of proposals for the automated notification system. This system will be used for calling in NRC response personnel in the event of a nuclear emergency and is one of several planned upgrades of the NRC Operations Center.

On April 7, the IRB staff conducted training for the Executive Team and other segments of the response team in preparation for the NFS Erwin exercise.

Region II management and staff participated in this training effort via teleconference.

On April 7-8, an IRB staff member met with the Federal Emergency Management Agency (FEMA), Region II, in New York, in preparation for the upcoming exercise at the Shoreham Nuclear Power Plant. Progress was made in understanding the manner in which the exercise will be conducted and the NRC resources required. Issues were identified where management direction will be sought before the next meeting.

Diagnostic Evaluation and Incident Investigation Branch The letter to Duke Power Company forwarding the Diagnostic Evaluation Team Report for the McGuire Nuclear Station was signed by the NRC Executive Director for Operations (EDO) on April 6, 1988 and mailed to the utility on April 8.

The team concluded that the overall perfortnance of McGuire was a solid Systematic Assessment of Licensee Perfonnance (SALP) Category 2 with an improving trend.

Although the team observed a number of strengths in Duke's organization and programs which contributed to the improving trend, the team also identified some organizational and programatic weaknesses, which could slow down the ,

improvement efforts. The utility was requested to evaluate the report and to I provide a written response to the EDO. The NRC staff will review and follow-up on the detailed findings of the evaluation and the utility responses.

Technical Training Center The Technical Training Center (TTC) Director participated in a briefing of the Advisory Committee on Reactor Safeguards (ACRS) on NRC technical training l programs. This briefing included a status report on the scope and quality of I TTC training, the TTC reactor technology and specialized technical training curricula, the TTC facility and capabilities, and new initiatives following the NRC reorganization. The ACRS human factors subcomittee was invited to conduct a future meeting at the TTC facility.

The first Severe Accident Overview Seminars were conducted by a TTC instructor at the Region I facility on April 5, 1988 and April 6, 1988. These seminars provide an overview of the Safety Parameter Display System; Emergency Operating Procedure (EOP) background, logic, and instrumentation response; degraded core assessment; and containment response during severe accidents. These seminars in Region I were based on the Westinghouse design.

WEEK ENDING APRIL 8, 1988 l INTERNATIONAL PROGRAMS l Bilateral Nuclear Safety Cooperation with the U.S.S.R.

On Wednesday GPA participated in an interagency meeting to coordinate plans for the April 25 - May 3 visit of a Soviet delegation of senior atomic energy officials. Current plans for the visit include tours of DOE and NRC-licensed facilities, and discussions at the Department of State of U.S.-Soviet cooperation in the peaceful uses of atomic energy. During this visit, Chairman Zech plans to sign a 5-year Memorandum of Cooperation between the U.S. and the U.S.S.R. in the field of nuclear safety.

Meeting with Mr. Jaroslav Micke (Czechoslovakia) on Nuclear Safety Cooperation On Wednesday, April 6,1988 Mr. Jaroslav Micke, Director, Department of International Cooperation of the Czechoslovakian State Committee for S&T, visited NRC to advance the process of initiating nuclear safety cooperation between the two countries. Mr. Micke was accompanied by two representatives of the Czechoslovak Embassy. NRC meeting participants were Victor Stello (EDO),

Harold Denton (GPA) Eric BecLjord (RES), and Ron Hauber and Hans Schechter (GPA/IP).

It was agreed that both sides needed to flesh out and prioritize the list of safety topics of mutual interest which had been identified during Comissioner Bernthal's visit to Czechoslovakia last fall, and settle on a few items for discussion during an upcoming visit to the U.S. by a Czech technical team. The tentative time frame for this visit is late October 1988. Both sides agreed to keep in touch in the interim.

Meeting of Rocky Mountain LLW Board The Rocky Mountain (Colorado, Nevada, New Mexico, and Wyoming) Low-level l Radioactive Waste Board met in Denver, Colorado on Wednesday, April 6. The  !

Board gave conditional approval to the Environmental Protection Agency (EPA) to l export Denver's radium waste to a Clive Utah disposal site in 1988 and 1989 provided a Rocky Mountain regional facility does not become available. EPA estimates it will generate 116,000 cubic yards of radium-contaminated material from the clean-up of some 44 Superfund-listed properties in the Denver area.

The Board also approved an application from the Colorado School of Mines to send 6,700 cubic yards of radium-contaminated waste to Utah. In other business, the Board agreed to provide up to $107,500 in matching funds to assist Colorado in its low-level waste siting efforts and rejected a contract proposal from the State of Vennont to send its non-reactor waste to the Rocky Mountain region's Beatty, Nevada site.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $2,500 was issued on April 5, 1988 to Joslin Diabetes Center, Inc., Boston, Massachusetts. The action was based on violations including a cumulative radiation exposure of 35.13 rem to the right hand of a research investigator during the fourth calendar quarter of 1987, an amount in excess of the regulatory limit of 18.75 ren. SECY-88 Proposed Final Rule Revising Agency Procedures Governing Ex Parte Communications and Separation of Functions The Commission, by a 5-0 vote,* approved final amendments to 10 CFR Parts 0 and 1 that revised the Commission's ex parte and separation of functions rules. The amendments update the existing rules by incorporating requirements imposed by the Government in the Sunshine Act as it relates to ex parte communications. The final rule also allows members of the NRC staff to serve as confidential advisors to the Commission with respect to a contested proceeding so long as those members do not act as investigators or litigators in the proceeding. The rule is intended to aid in maintaining effective communication between decision-making officials and NRC staff personnel and individuals outside the NRC while ensuring that proceedings are conducted in an impartial manner.

l T Section 201 of the Energy Reorgani::ation Act, 42 U.S.C. I S5841, provides that action of the Commission shall be deter-mined by a "majority vote of the members present." Commissioners Bernthal and Carr were not precent when this item was affirmed.

Accordingly the formal vote of the Commission was 1-0 in favor of the decision. Commissioners Bernthal and Carr, however, had previously indicated that they would approve this paper and had they been present they would have affirmed their prior votes.

Insofar as the petition requests a discretionary formal restart hearing on matters outside the scope of-this proceeding, that request was denied in a separately addressed letter to Governor Carey.

Chairman Zech and Commissioner Bernthal requested that staff be prepared to address questions on how the staff concluded that
