APPENDIX A NOTICE OF VIOLATION i
Spectrochem Laboratories, Inc.
Docket No. 070-02895 Franklin Lakes, New Jersey 07417 License No. SNM-1856 As a result of the inspection conducted on January 21, 1988, and in accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2, Appendix C (Enforcement Policy) (1986), the following violations were identified:
A.
Condition 13 of License No. SNM-1856 requires that licensed material be possessed and used in accordance with the statements, representations and procedures contained in an application dated December 27, 1978, as amended February 28, 1979, and letters dated May 7, 1980 and July 21, 1980.

This application, as amended, requires that the urine of each person involved in the use of licensed material be checked for uranium semi-anually.
Contrary to the above, as of January 21, 1988, the urine of persons involved in the use of licensed material was checked for uranium during January, 1986 and March, 1987.
This interval exceeded the required semi-annual frequency.

2.
This application, as amended, requires that monthly swipe samples be made of the laboratory area.
Contrary to the above, as of January 21, 1988, monthly swipe tests were not performed.
3.
This application, as amended, requires that a quarterly survey be performed by a consultant.
Contrary to the above, as of January 21, 1988, a survey by a consultant was performed only in September, 1987.
These are Severity Level IV violations.

B.
Condition 12 of License No. SNM-1856 limits the use, or supervision of use, of licensed material to named individuals.
Contrary to the above, as of January 21, 1988, use of licersed material was not by or under the supervision of either of the two named individuals, who were no longer employed by the licensee.
This is a Severity level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Spectro Chem Laboratories, Inc. is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Where good cause is shown, consideration will be given to extending this response time.
