Gentlemen:

Subject: Inspection No. 50-333/88-07

To verify the Emergency Response Facilities (ERFs) at licensed nuclear power

plants meet the requirements of 10 CFR 50.47(b), Appendix E of 10 CFR Part 50,

and orders issued to implement Supplement 1 to NUREG-0737, the NRC cor ; cts

special appraisals of these facilities.

During the period of May 16-20, 1988, the NRC conducted a special ERF Appraisal

at the FitzPatrick Nuclear Power Plant, authorized by NRC Operating License No.

DPR-59. Areas examined during the appraisal are described in the NRC Region I

inspection report which is enclosed with this letter. Within.these areas, the

inspection consisted of selective examination of procedures and representative

records, the ERFs and related equipment, interviews with personnel and observation

of the 1988 emergency exercise by appraisal team members.

Based on the results of this inspection, it appears that one of your activities

was not conducted in accordance with your commitments made in a letter dated

April 15, 1983, to abide by certain criteria set forth in NUREG-0737, Supplement

1. In accordance with the "General Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy 1988), the

deviation is set forth in the enclosed Notice of Deviation (Appendix A). .You ,

are requested to respond to this letter and in preparing your response, you j

should follow the instructions in Appendix A. The appraisal also indicates  !

that several areas were found to be incomplete and will be reinspected, along l

with other areas of concern. These findings are listed in Appendix B, Appraisal  :

Open Items. Please advise us within 45 days of the date of this letter of - l

action you plan to take, showing the estimated date of completion with regard

to the findings identified in Appendix B. (Note: Response to the Notice of

Deviation is required within 30 days of the date of this letter.)

The findings also indicate that there are items in your emergency preparedness

program which need improvement. These items are identified in the text of the

enclosed inspection report. These improvements are areas which, based upon

professional judgement, require your review and consideration.
