On May 24, 1988, Maine Yankee Atomic Power Station shipped dewatered filters

designated as Radioactive Material, LSA, n.o.s., to the Chem-Nuclear Systems,

Inc. burial facility in Barnwell, South Carolina.

The shipment was made by an

exclusive use carrier on a tractor-trailer containing Cask Model No. HN-215-2.

On May 27, 1988, a representative of the South Carolina Department of Health

and Environmental Control (SCDHEC) inspected the shipment. The inspection

consisted of a review of shipping documentation, placarding, marking and

labelling, radiation measurements, contamination surveys, and examination of

packages on the vehicle.

A copy of the inspection report prepared by the SCDHEC is enclosed. The

report indicated that the waste shipment was improperly classified with

respect to Condition 38 of South Carolina Radioactive Material License 097

issued to Chem-Nuclear Systems, Inc.

10 CFR 20.301(a), Waste Disposal, General Requirement, requires that no

licensee shall dispose of licensed material except by transfer to an

authorized recipient as provided in the regulations in Parts 30, 40, 60, 61,

70, or 72 of this chapter, whichever may be applicaole.

10 CFR 30.41(c),

Transfer of byproduct material requires that before transferring byproduct

material to a specific licensee of an Agreement State, the licensee

transferring the material shall verify that the transferee's license

authorizes the receipt of the type, form and quantity of byproduct material to

be transferred.

According to the SCOHEC representative, the concentration of radioactive

materials with half lives greater than five years exceeded one microcurie per

cubic centimeter in filter number five.

This is in excess of the

requirements of Radioactive Material License 097 issued by South Carolina to

Chem-Nuclear Systems, Inc.

The Maine Yankee Atomic Power Company Station Superintendent was informed of

this apparent violation of NRC req

ements in a telephone conversation with

Dr. Walter J. Pasciak of the NRC Region I of fice on June 21, 1988.
