Your application dated September 11, 1987, requested that the 10 CFR 171 FY 1988 annual fee for the Big Rock Point Plant be reduced to $19,560 of i i the publithed annual fee of $936,000 You cited as the bases for such exemption the _ smallness and age of the planti its very low output in i kilowatt hours, and that the impact of annual fees is approxintely 12 times greater than for a typical modern vintage plant.

3 From car evaluation of your application in accordance with 10 CFR 171.11, we have determined that a partial exemptio.. of the FY 1988 annual fee is  !

j sppropriate fcr the Big Rock Point Plant. Therefore, an exemption is hereby approved. This exemption results in a reduction (,f the annual fee to 8.5 percent of the $936,000 using the averaging method applied in -

the exemption approved for FY 1987 on April 15, 1987. Accordingly, the Big Rock Point Plant annual fee is currently $80,000. Enclosed is '

invoice No. G0611 for this arrount.

As you are aware, legislation was signed in December 1987 which requires NRC to collect 45 percent of its FY 19o8 budget of $392.8M in fees under ,

10 CFR 170 and 171. Consequently, the FY 1988 annual fee amount of '

$9M,000 will be adjusted. At such time as the amount of the increased annual fee under 10 CFR 171 for FY 1988 has been determined, your  :

Company will be billed for an additional sum which will be 8.5 percent ,

of the increase for each plant. On this basis, your Company will be '

issued another invoice for annuci fees for FY 1988 l

Other Consequences for Failure to Pay on a Timely Basis, a) If a quarterly installment of the annual fee is not received within 30 days from the -

invoice date the balance of the annual fee becomes due and payable, with interest.and ~

penalties calculated frem tho invoice date (10 CFR 171.25).

b) If the annual fee is not pair' when due, the Comission may refuse to' process any appit-cation person,submitted by or onorbehalf and may suspend revokeofany thelicenses personheld withby respect to any(clicense the person issued 10 CFR 171.23).. Theto the suspension or revocation of a license does not waive or affect any debt due from a licensee.

a) .The NRC will not extend the 30-day-interest-waiver period because of.the submission' i t of an application for exemption from the annual fee pursuant to 10 CFR 171.11. .

b) If the NRC grants an exemption', the NRC will make an adjustment upon invoicing the .

balance of the annual fee and will make a refund only to the extent that the annual fee.
