Dear Senator Mitchell:
This letter is in response to your June 13, 1988 letter to Chairman Zech. On behalf of a constituent, you inquired whether there is a federal plan for compensating people who live within a nuclear power plant emergency planning zone, and if so, how compensation is distributed.
Under non-emergency conditions, there is no federally mandated compensation to people who live in an emergency planning zone.
The Price. Anderson Act, however, provides for compensation to persons who have sustained a loss due to an accident at a nuclear power facility.
Local compensation associated with the construction and/or operation of a nuclear power plant is variable and
)
primarily determined by the local and State tax provisions applicable to each facility.
In addition to local and State taxes, nuclear utilities have often augmented local and State resources dedicated to responding to emergencies, e.g., fire fighting equipment.
However, these arrangements have been the culmination of utility, local and State efforts, and are not due to any program required by the federal government. Accordingly, there is no federal program for the distribution of local compensation from nuclear power facilities.
