By application dated September 28, 1978, you requested an amendment to License No. DPR-33 to permit operation of Browns Ferry Unit No. 1 at a power level greater than 50% of rated power with one recirculation loop isolated for the remainder of the current fuel cycle. This request was approved on September 29, 1978, as Amendment No. 43 to License No. DPR-33.

In your application, you stated that the fees of 10 CFR 170.22 were not applicable because this information was requested by the NRR staff to complete the review of your September 15, 1978 application. On September 19, 1978, Amendment No. 41 was issued to approve your September 15 application based on the data provided in that application which supported approval of your request with a 50% power limitation. It is our under-standing from the NRR review staff that at your request the amendment for 50% power operation was issued before receiving the additional data from you to support evaluation and approval of the higher power level. Because of this, we do not consider your September 28 application to be supple-mental to your request of September 15 nor do we consider it an increased charge resulting from the NRC's separation of your original application.

From our final review of the September 28 application, we have determined that it involved consideration of a single safety issue and as such falls in fee Class III. It is requested that you forward the $4,000 promptly to this office.
