Dear Mr. Black:
This letter serves to document several actions regarding the Babcock & Wilcox ECOSAFE HIC-55 Topical Report.
On March 30, 1988, NRC staff met with you and other representives from Babcock & Wilcox (B&W) and from Avancer Technologies, at which time you submitted ten (10) proprietary and five (5) non-proprietary copies of a draft of the ECOSAFE HIC-55 Topical Report, numbered BAW-2037.
In the course of determining whether this craft submittal was final, B&W decided to submit a revised Topical Report to ir;clude additional structural analyscs. Ten (10) proprietary and five (5) non-proprietary copies of this revised Topical Report were received at NRC Headquarters on April 23, 1988, and the previously submitted draft Topical Reports were destroyed.
An acceptance review was performed on the Topical Report to determine if it contained complete information and if NRC could begin detailed technical review of the Report. The conclusion of this review was that additional information was required on the results of one test procedure reported in Appendix C of the Topical Report in order for NRC to accept it for review.
B&W submitted the required additional information by telefax on April 18, 1988.
With this submittal, HRC found the Topical Report acceptable for review, and docketed the ECOSAFE HIC-55 Topical Report.
For reference purposes, the ECOSAFE HIC-55 Topical Report is docketed under No. WM-95.
Following docketing, B&W's remittance pursuant to 10 CFR 170.12 was processed. On May 4,1988, a videotape containing results of the prototype 25-drop tests was received at NRC Headquarters, and this videotape will be inluded in NRC's technical review of the Topical Report.
The ECOSAFE HIC-55 Topical Report contains information that you requested be considered proprietary in accordance with NRC regulations.
The required affidavit containing supporting information to this request was included witn B&W's submittal of the draft Topical Report. NRC will treat the ECOSAFE hic-55 Topical Report and supporting information as proprietary information within the provisions of 10 CFR 9.5(4).
If there is a need to consider the public disclosure of any of B&W's proprietary material, NRC would notify B&W prior to making a disclosure determination and this disclosure determination would be made in accordance with the procedures and conditions of 10 CFR Part 9, Subpart A.

. MAY 121988 B&W employ the information in the Topical Report as part of any action identified in 10 CFR 2.790(a), such data shall be separately submitted and such a submittal shall include an application for withholding accompanied by
'an affidavit meeting the requirements of 10 CFR 2.790(b). This formal submittal of a final topical report must also include non_ proprietary versions of the final topical report.
Portions of the ECOSAFE HIC-55 Topical Report technical review will be conducted by contractors to the NRC. The next step in the' review process will be' to establish the necessary contracting documents to perform these reviews.
When this has been completed, a schedule for the ECOSAFE HIC-55 Topical Report review will be established and transmitted to you.
I anticipate establishing this schedule and transmitting it to you by May 27, 1988.
