Dear Mr. Baer:

By this letter, the Authority commits to modify the Greene County N'1 clear Power Plant design to satisfy the NRC's Cold Shutdown Requirements indicated in Enclosure (1) of i

your October 20, 1978 letter.

We make this commitment as a matter of licensing expediency in light of the NRC's refusal to treat this issue as a generic concern.

Our commitment should not be construed as an Authority agreement with the j

present NRC posture on the Cold Safe Shutdown issue.

In fact, the Authority fully agrees with and supports the B & W comment made in response to proposed Regulatory Guide 1.139

" Guidance for Residual Heat Removal" that this new requirement "will impose a significant financial burden on the industry and add further complexity to the plant while providing little, if any, safety or reliability benefits."

Notwithstanding our commitment to meet your present require-ments, the Authority reserves the right to take advantage of any relief which results "Es*an outgrowth of future industry /

NRC discussions on this issue.

If less restrictive NRC require-ments are promulgated, then the Authority will notify you and indicate any changes to the GCNPP dmign made to meet such requirements.
