(0yster Creek Nuclear Generating 4 Station) March 17,1988 ORDER On February 25, 1988 counsel for Petitioner Frank Aller filed a Motion to Withdraw Request for Hearing which request Petitioner had filed on December 4, 1987. The motion now before this Board reflects the agreement reached with Petitioner's counsel and the NRC Staff. It meets the procedural shortcomings perceived by counsel in respect to the November 7,1987 Confirmatory Order issued to GPU Nuclear Corporation as Licensee of the Oyster Creek Nuclear Generating Station.
Counsel for NRC Staff is represented as having no objection to the giant of the subject motion. This was confirmed with Staff counsel by telephone on March 4, 1988.
On February 29, 1988 Licensee's Response to Frank Aller's Motion to Withdraw Request for Fearing was filed with the Board. Although Licensee did not participate in the meeting between Petitioner's counsel and the Staff which resolved the prublems, Licensee concurs in the motion to withdraw the hearing request.
