Dear Administrative Judges:
On December 8, 1987, TU Electric's licensing counsel, Mr. Eggeling, informed the Board that, due to recent developments in the state court litigation, TU Electric was investigating whether any of the previously withheld Cresap, McCormick &
Paget materials should be disclosed.
TU Electric has recently completed its investigation and has concluded that the Cresap materials should be produced to CASE.
Accordingly, by letter of this date (copy attached) TU Electric has notified Ms. Ellis of the availability of the Cresap materials.
We believe that this production will render the partles' dispute over the discover-ability of the Cresap materials largely moot.

Dear Ms. Ellis:
As you were previously advised by Mr. Eggeling's letter of December 8, 1987, TU Electric has been involved in a review of the Cresap, McCormick & Paget materials in light of various recent developments in the state court proceedings involving the minority owners.
That review has been completed and TU Electric has concluded that in addition to the Category 1 documents previously made available, it would be prepared to make available to CASE those Cresap materials TU Electric now possesses which were produced by Cresap in the state court litigation.
In addition, TU Electric is prepared to make avail-able all of the Category II documents which were the subject of the Board's stay order of July 21, 1987.
TU Electric's willingness to make these documents available to CASE is sub ect to three relatively insignificant j
conditions:
1.
that it be understood that TU Electric is not thereby in any way acquiescing in the Texas state court rulings which resulted in these documents being made available to the Minority Owners of Comanche Peak;

that TU Electric does not waive, except to the extent of such production, any other previously expressed claims or privilege, including TU's claim of privilege regarding the work product of its agents and consultants; and, 3.
that by making these documents available TU Electric does not acknowledge that the documents are relevant or material to, or admissible in, either this proceeding or the related OL Docket.
If these conditions are acceptable, TU Electric will immediately place in the Document Room in Dallas, Texas the relevant non-privileged Cresap materials.
With the production of these Cresap materials we believe that disputes between CASE and Applicants regarding the Cresap documents are now largely moot.
