e NOTICE OF VIOLATION The Cleveland Electric Illuminating License No.
NPF-58 Company As a result of the inspection conducted on December 31, 1987 through February 22, 1988, and in accordance with the "General Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the following violations were identified:
1.
Perry, Unit 1 Technical Specification 3.3.7.9 requires, in part, that at least once per twelve hours, emergency service water (ESW) system effluentgrabsamplesbeobtainedandanalyzedfoygrossactivity(beta or gamma) at a limit of detection of at least 10 microcuries/ml during effluent releases via the ESW system whenever the associated ESW discha ge radiation monitor is inoperable.
Contrary to the above, between January-3 and 5, 1988, while discharging effluent via the ESW system with the ESW loop A radiation monitor inoperable,grabsampleswerenotanalyzedforgrossactiyjtywitha method which provided a limit of detection of at least 10 microcuries/ml.
This is a Severity Level V violation (Supplement I).

Perry, Unit 1 Technical Specification 4.8.1.1.3 requires, -in part, that 1
if the number of diesel generator test failures in the last 100 valid tests, on a per nuclear unit basis, is greater than or equal to 7, the 30-day special report shall be supplemented to include the additional information recommended in Regulatory Position C.3.b of Regulatory Guide 1.108, Revision 1, August 1977.
Contrary to the above, the special report dated March 27, 1987, for the seventh failure in the previous 100 valid tests on a per nuclear unit basis, was not supplemented to include the information recommended in Regulatory Position C.3.b of Regulatory Guide 1.108, Revision 1, August 1977.
This is a Severity Level V violation (Supplement I).

This is a Severity Level IV violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this.
office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
