REVIEW 0F LICENSE AMENDMENT APPLICATION DATED AUGUST 11, 1978 l I Background Babcock & Wilcox, Commercial Nuclear Fuel Plant (CNFP), by application dated August 11, 1978, requested authorization to possess by-product, source, and special nuclear material for

'the purpose of delivery to a carrier for transport and in private carriage between NRC licensed facilities in the United States.

The authorization is currently necessary for the transfer of these materials on public roads between adjacent Babcock & Wilcox NRC l licensed facilities in Lynchburg and, at some future date, between l the CNFP and other NRC licensed facilities in the United States.

l II Discussion The requested authorization will expedite the transport of '

by-product, source, and special nuclear material between NRC licensed facilities that are associated with the CNFP operations.

When the CNFP accepts possession of authorized radioactive materials at other NRC licensed facilities for the purpose of delivery to a carrier for transport, CNFP will provide the user of the package with applicable package handling procedures and instructions and review the applicable user's procedures for conformance with the packaging and transportation requirements of 10 CFR Part 71 and 49 CFR. Applicable NRC and D0T regulations will also be followed in the packaging and transport of radio-active materials from the CNFP. " Procedures for picking up, receiving, and opening packages," 10 CFR 20.205, will be followed.

Since only nuclear criticality and radiological safety controls and procedures authorized for handling radioactive materials by the shipper and receiver will be followed, there will be neither 7r//tm zu c

a significant change in nuclear criticality safety nor in the radiological effects from the requested authorization. Neither should there be a significant environmental effect from the proposed activity. -

General l

The amendment applicatio'n of August 11, 1978 was discussed with John B. Kahle, Region II (I&E) inspector of the B&W facility on September 12, 1978. He saw no safety or environmental problems with the authorization to possess radioactive material for the purpose of delivery to a carrier and in private c?rriage.

III Conclusion Authorization to possess radioactive material for the purpose of delivery to a carrier and in private carriage does not affect the presently authorized nuclear criticality and radiological safety controls and procedures. They are adequate to protect the health and safety of the operating personnel, the public, and the environ-ment.

Issuance of the license amendment is recommended.
