NOTICE OF VIOLATION Georgia Power Company Docket No. 50-425 Vogtle 2 License No. CPPR-109 6'
During the Nuclear Regulatory Comission (NRC) inspection conducted on May 9-13, and 23-26, 1988, a violation of NRC requirements was identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1987), the violation is listed below:
10 CFR 50, Appendix B, Criterion X, and the licensee's accepted Quality Assurance (QA) program Final Safety Analysis Report (FSAR) Section 17.1.10 collectively require that a program for inspection of activities affecting quality be established and executed by or for the organization performing the activity.
The Vogite FSAR, Section 1.9.58, commits to Regulatory. Guide (RG) 1.58, Revision 1, Qualification of Nuclear Power Plant Inspection, Examination, and Testing Personnel.- This RG endorses ANSI /ASME N 45.2.6-1978, Qualifications of Inspection, Examination, and Testing Personnel for Nuclear Power Plants. Section 3.5.3, Level III, of this standard establishes the requirements for Level III inspectors.
Contrary to the above, the licensee has not established a program for inspection personnel that meets requirements to their commitments to ANSI /ASME N 45.2.6.-1978, Section 3.5.3, for Level III inspectors, in that, they have established an Administrative Level III inspector that performs the same duties of a Level III inspector withcut having the required educa-tion.and/or experience levels and/or without the required certification for a Level III inspector.
This is a Severity Level V violation (Supplement II).
Pursuant to the provisions of 10 CFR 2.201, Georgia Power Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, Vogtle, within 30 days of the date of the letter transmitting this Notice.
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include [for each violation]:
(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.
Where good cause is shown~, consideration will be given to extending the response time.
