Your letter dated August 14, 1987 (SNRC-1359), requested an exemption from the annual fee requirements of 10 CFR 171 for FY 1988 or until such time as the Shoreham Nuclear Power Station is licensed to operate above 5% of the rated power level. It is your position that while Long Island Lighting Company (LILCO) has had a license since December 1984, you cannot produce marketable electric power because LILCO's license is '

limited to 5% of rated thennal power. In addition, you stated that LILCO is faced with increased costs due to protracted licensing h proceedings. It is your contention that the limit on the power level and the increased costs are because of the lack of cooperation by the State and local governments.

We have completed the review and evaluation of your request in i

accordance with 10 CFR 171.11. Based on the evaluation of all pertinent issues on the case, we have detennined that an exemption from the l FY 1988 annual fee requirements is in order for Shoreham; therefore, the l exemption is hereby granted. However, in the event Shoreham is authorized to operate above 5% of rated thennal power in FY 1988 (i.e.,

on or before Septeeber 30,1988), this exemption will no longer apply.

LILCO would be billed for the applicable prorated costs for the remainder of the fiscal year.
