Your letter dated September 25, 1987, requested a total exemption from the annual fee requirements of 10 CFR 171 for FY 1988 and from any future 10 CFR 171 fees for the remainder of the TMI-2 cleanup period, includingPost-DefuelingMonitoredStorage(PDMS). The justification for your request was that THI-2's license is comparable to a "possession only" license and that tb reactor should be considered a ":ero" power facility since it is incapable of operation in its present condition.
It is your position that GPU receives the same limited oenefits from NRC's generic programs as those "possession only" licensees that are already excluded from the fee requirements of 10 CFR 171.
We have completed our review and evaluation of your request in accordance with 10 CFR 171.11.
Based on the evaluation of all pertinent facts and the uniqueness of the case in that GPU Nuclear has been limited since 1979 to a license authority which provides for maintenance and cleanup of the facility and not operation, we have detennined that an exemption from the FY 1988 annual fee requirements is in order for TMI-2; therefore, the exemption is hereby granted. This exemption is limited to FY 1988 only and is not applicable to any cleanup period or PDMS occurring after the end of FY 1988 on September 30, 1988 Sincerely, Oric.:. '
